With the widespread application ofmedical artificial intelligence (AI) in contemporary healthcare, it has broughtethical challenges such as patient personal information protection, the rightto self-determination, and uneven distribution of medical resources. Meanwhile,medical AI involves multiple subjects and complex responsibility divisions. Thecharacteristics of autonomous decision-making and opaque algorithms increasethe difficulty of responsibility determination. Traditional causality andimputation principles struggle to address the regulatory dilemmas posed bymedical AI. Therefore, it is essential to deeply explore the ethics andresponsibilities of medical AI, analyze the underlying complex mechanisms, andprovide theoretical support and practical guidance for building a comprehensiveethical and responsibility system. Specifically, specialized ethical guidelinesshould be formulated, from overarching principles to specific plans, followingexplainability rules to eliminate ethical challenges. Balancing technologicalinnovation and ethical responsibilities, we should promote the progress ofmedical AI while maintaining ethical bottom lines. Additionally, improving theresponsibility system requires clarifying the positioning of human-machinerelationships, identifying responsible subjects, establishing causality andimputation principles, and providing a basis for attributing medical AI-relateddiagnosis and treatment errors and product responsibilities.

의료인공지능이 현대 의료분야에서 광범위하게 활용됨에 따라 환자의 개인정보보호, 자기결정권, 의료자원 배분의 불균등 등에 대한 다양한 윤리적 딜레마 를 초래하였다. 또 의료인공지능은 의료사고가 발생했을 때 다양한 주체로 인해 책임구분이 복잡하고, 자율적인 의사결정과 알고리즘이 불투명하다는 기술적 특 성이 책임 인정의 어려움을 증가시킨다. 이로 인해 전통적인 인과관계와 귀책원 칙으로는 의료인공지능이 가져오는 책임규제 문제에 대응하기 어렵다. 그러므로 의료인공지능과 관련한 다양한 윤리문제와 책임규제를 깊이 있게 탐구하여, 그 뒤에 숨겨진 복잡한 메커니즘을 분석함으로써 완벽한 윤리 및 책임 체계를 구 축하기 위한 이론적 지원과 실무적 지침을 제공할 필요가 있다. 즉, 의료인공지 능에 대한 전반적 원칙에서 구체적 방안까지 전문적인 윤리 준칙을 제정하고, 이에 따라 의료인공지능이 가져오는 윤리적 딜레마를 해결해야 한다. 이를 통해 기술혁신과 윤리적 책임을 균형 있게 조정하고, 의료인공지능기술의 진보를 촉 진하는 동시에 윤리의 최저선을 지켜야 한다. 또한, 책임체계를 완비하고, 인간 -기계 관계의 지위를 명확히 하여 책임주체, 인과관계, 귀책원칙을 명확히 함으 로써 의료인공지능의 진료과실과 제조물 손해로 인한 배상책임의 근거를 제공하여야 한다.

伴随着医疗人工智能在当代医疗领域中的广泛应用，其带来了患者个人信息保 护、自主决定权、医疗资源分配不均的伦理挑战。同时，医疗人工智能涉及到主体 多元、责任划分复杂，其自主化决策、算法不透明的技术特性增加责任认定难度， 传统的因果关系和归责原则难以应对医疗人工智能带来的责任规制难题。应深入探 讨医疗人工智能的伦理与责任，剖析其背后的复杂机理，为构建完善的伦理和责任 体系提供理论支持与实践指导。具体来说，应制定专门的伦理准则，从总体原则到 具体方案，按照可解释性规则，消除医疗人工智能带来的伦理挑战。平衡技术创新 与伦理责任，在促进医疗人工智能技术进步的同时，守牢伦理底线。同时，完善责 任体系，明确人机关系的定位、明确责任可能的主体、因果关系及归责原则，为医 疗人工智能诊疗过失和产品责任的承担提供依据。
