The right to medical self-determination concerns the life, health, and personal dignity of individuals with intellectual disabilities. China's Civil Code stipulates that individuals with intellectual disabilities either do not enjoy or have limited enjoyment of this right, which may restrict their medical autonomy and harm their personal interests. To address this issue, it is proposed that when handling medical decision-making for individuals with intellectual disabilities, their true wishes should be respected while ensuring the maximization of their interests, thereby achieving a legislative balance between the values of freedom and benefit. Based on whether the decision falls within the scope of their medical decision-making capacity, differentiated approaches should be adopted: For matters within their capacity, individuals with intellectual disabilities should make independent decisions. If physical or mental barriers prevent them from expressing their will to others, their legal representatives may assist in conveying their intent or apply a presumption rule to determine their true wishes. For matters beyond their capacity, priority should be given to allowing legal representatives to assist them in making joint medical decisions, thereby supplementing their residual decision-making ability. If the individual lacks any residual capacity, the legal representative should make substitute medical decisions on their behalf.

의료자기결정권은 성인 정신장애인의 생명, 건강, 개인의 존엄성과 관련이 있다. 중국 「민법전」은 정신장애인이 이 권리를 누리지 못하거나 제한적으로 누릴 수 있다고 규정하고 있는데, 이는 정신장애인의 의료자율권을 제한하고, 개 인의 이익을 해칠 수 있다. 이 문제를 해결하기 위해 정신장애인의 의료의사결 정을 행사할 때 그들의 진정한 의사를 존중하는 동시에 그들의 이익을 극대화 하여 자유와 이익의 가치 사이에서 입법적 균형을 이루어야 한다. 의사결정이 의료의사결정능력의 범위에 속하는지 여부에 따라 차별화된 접근 방식을 채택해야 한다. 즉, 의사능력 내에 속하는 경우에는 정신장애인이 독립 적으로 결정을 내릴 수 있도록 해야 한다. 신체적 또는 정신적 장애로 인해 다 른 사람에게 의사를 표현할 수 없는 경우, 법정대리인은 의사전달을 도울 때 의 사추정원칙을 적용하여 정신장애인의 진정한 의사를 대리하여 결정할 수 있다. 한편, 의사능력 범위 외에 속하는 경우에는 법정대리인이 공동의료결정을 내리 는 데 도움을 줄 수 있도록 하여 잔여 의사결정능력을 보완하는 데 우선순위를 두어야 한다. 또 개인이 잔여 의사능력이 부족한 경우 법정대리인이 대리의료결 정을 내려야 한다.

医疗自我决定权事关心智障碍者的生命健康与人格尊严。中国《民法典》规定心 智障碍者不享受或有限享受该权利，这将限制其医疗自我决定与损害其人身利益。 为化解该问题，提出处理心智障碍者医疗决定事项时应尊重本人的真实意愿兼顾本 人利益最大化，达致自由与效益价值平衡的立法目的。 依据决定事项是否属于心智障碍者医疗决定能力的事项，予以差异化处理。对于 能力范围内的事项，由心智障碍者独立作出决定，若因身心障碍心智障碍者无法对 相对人表达意愿的，法定代理人帮助意思表示或者采取意思能力推定规则确定其真 实意思。对于超出能力范围的事项，优先让法定代理人协助其共同作出医疗决定， 补正其残余的意思能力；若心智障碍者不具有残余的意思能力，则由法定代理人替 代其作出医疗决定。
