This study analyzed the operational status and problems of private investigator-related private qualifications, based on the Framework Act on Qualifications and related regulations, and proposed measures for system improvement. The analysis identified the following key issues: First, the majority of private investigator qualifications are registered under the jurisdiction of the National Police Agency, yet the scope of this jurisdiction is ambiguous and potentially overlaps with other ministries. Furthermore, there is an inadequate legal basis for addressing the duplication of private qualifications. Second, a proliferation of identically named qualifications leads to difficulties in qualification selection, diminished credibility of certifications, and potential consumer harm. Third, the lack of clear obligations for qualification-issuing bodies to conduct examinations, combined with insufficient disclosure of examination-related information, undermines the transparency and reliability of qualification operations. To address these issues, this study makes the following policy recommendations: First, the legal basis for the field of private investigation must be clearly defined, and an efficient management and supervision system should be established. Second, the problem of qualification duplication should be tackled through guidelines for the use of private qualification names and the establishment of standardized job duties by qualification level. Third, mandating qualification examinations and increasing information disclosure are crucial to enhancing the transparency and trustworthiness of qualification operations. Fourth, from a long-term perspective, the legal status of the private investigation industry should be established and its sound development should be promoted through the legislation of the private investigation business.

본 연구는 「자격기본법」및 관련 법령에 근거하여 탐정 관련 민간 자격의 운영 현황과 문제점을 분석하고 제도 개선 방안을 제시하고자 하였다. 본 연구의 대상을 분석한 바에 따라 다음과 같은 문제점을 확인하였 다. 첫째, 탐정 민간자격 대부분이 경찰청 소관으로 등록되어 있으나 소관 업무 범위가 모호하고 타 부처 소관 분야와 중복될 가능성이 있 으며, 민간자격 중복성 해소에 대한 법령상 근거가 미흡하다. 둘째, 동일 명칭의 자격증이 중복되어 자격 선택의 어려움, 자격증의 신뢰도 저하, 소비자 피해 발생 우려가 존재한다. 셋째, 자격 발급 기관의 검 정 실시 여부에 대한 확인이 불명확하고 검정 관련 정보공개가 미흡하 여 자격 운영의 투명성과 신뢰성이 부족하다. 본 연구는 이러한 문제점 해결을 위해 다음과 같은 정책 제언을 제 시한다. 첫째, 탐정 분야에 대한 법령적 차원의 근거를 명확히 규정하 고 효율적인 관리 감독 체계를 구축해야 한다. 둘째, 민간자격 명칭 사용 가이드라인 마련, 등급별 표준 직무 설정 등을 통해 자격증 중복 성 문제를 해소해야 한다. 셋째, 자격 검정 의무화 및 정보공개 확대 를 통해 자격 운영의 투명성과 신뢰성을 강화해야 한다. 넷째, 장기적 관점에서 탐정업의 법제화를 통해 탐정업의 법적 지위를 확립하고 건 전한 육성을 도모해야 한다.
