This study aims to identify factors that contribute to trust in the courts. the instrumental model and the procedural justice model, which provide explanations of the factors influencing confidence in criminal justice institutions, were utilized to analyze the impact of the factors on the confidence in the courts. Using the Survey on Trust on Criminal Justice Agencies 2017 conducted by the Korean Institute of Criminology, a multiple regression analysis is conducted on 1,000 citizens aged 19 and older living in five major metropolitan areas, including Seoul, Gyeonggi, and Busan. The results of the multiple regression analysis showed that the effectiveness of the court, an instrumental factor, and distributive and procedural justice factors, had a significant effect on confidence in the courts. The findings also confirmed that the higher the economic level, the more conservative the political tendency, and the more experience with the courts, the higher the confidence in the courts. In addition, It was found that age and gender did not have a significant impact on confidence in the courts. The results of this study suggest that policies aimed at strengthening the effectiveness and procedural and distributive justice of the courts are required in order to increase trust in the courts.

이 연구는 법원 신뢰 영향요인을 분석하는 것이 목적이다. 이를 위해 이 연구는 형사사법기관 신뢰 영향요인을 설명하는 도구적 모델과 절차적 정의 모델을 이론적 틀로 활용하여 주요 요인을 추출하고 법원 신뢰에 미치는 영향력을 실증적으로 분석하였다. 연구 대상은 서울, 경기 및 부산 등 5대 광역시에 거주하는 19세 이상 성인 남녀 총 1,000명이며, 한국형사정책연구원이 수행한 ‘2017년 형사사법기관에 대한 신뢰도 조사’를 2차 자료로 활용하였다. 다중회귀분석결과, 도구적 모델 요인인 법원 효과성과 절차적 정의 모델 요인인 분배적 공정과 절차적 공정이 증가할수록 법원을 더 신뢰하는 것으로 나타났다. 이밖에 경제수준이 높을수록, 정치성향이 보수적 일수록, 법원 경험이 있을수록 법원 신뢰가 더 높은 것으로 분석되었다. 연령과 성별은 법원 신뢰에 유의하 게 영향을 미치지 않는 것으로 나타났다. 연구결과를 토대로 법원 신뢰를 제고시키기 위해 법원은 법적 분쟁을 법과 원칙에 따라 적절히 해결하고, 범죄자에게 형벌을 적정히 부과하며, 재판결과에 대한 이의 제기 권한을 충분히 보장해줄 필요성이 상당하였다. 또한 신속하고 정확하게 재판을 진행하고, 사건 이해 당사자의 사회ㆍ경제적 지위나 언론 등 그 밖에 외부 요인에 영향을 받지 않고 양형을 선고한다는 인식을 심어줄 필요성을 제안하였다.
