This study aims to examine the cohesion between three levels of society in responding to the crime of industrial espionage: the research level, the media level and the policy level. To do this, we examined the extent to which factual evidence is provided on the effectiveness of prevention strategies (deterrence strategies and general prevention strategies) for industrial technology leakage at the research level through a systematic review, and examined how these prevention strategies are reflected through the media level to the policy level through big data analysis of media and government reports to answer the question: 'Are prevention strategies with factual evidence reflected in policy through the media, a communication channel in a democratic society? The results show that both deterrence-based and general prevention strategies have not been proven to be effective by strict criteria at the research level, but there is limited evidence of effectiveness at the research level; deterrence strategies that focus on the severity of punishment (sentencing) are mainly discussed at the media level; and both deterrence and general prevention strategies are evenly distributed at the policy level. From this, the study identified a degree of instability in the current multi-layered structure of industrial espionage and suggested the need for factual evidence that meets the standards of experimental criminology on the effectiveness of deterrence and general prevention strategies as a future task.

본 연구는 산업기술유출이라는 범죄에의 대응에 있어서 우리사회를 연구층위, 언론층위, 그리고 정책층위 3개의 층위로 분류하고, 그 사이의 응집성에 대한 검정을 수행하고자 하였다. 이를 위해서 우선 체계적 문헌고찰을 통해 연구층위에서 산업기술유출에 대한 예방전략(억제전략 및 일반예방전략)의 효과성에 대해 얼마만큼의 사실적 근거들을 제공하고 있는지 확인하고, 이 예 방전략들이 언론층위를 거쳐서 정책층위까지 어떻게 반영되고 있는지를 각 미디어 빅데이터 분 석과 정부 보고서 분석을 통해서 확인하여 ‘사실적 근거를 갖춘 예방전략이 민주사회의 소통채 널인 언론을 통해서 정책까지 반영되었는가?’에 대한 물음에 대한 답을 구해보았다. 그 결과, 연 구층위에서는 억제중심의 예방전략 및 일반예방전략 모두 엄격한 기준의 효과성에 대한 증명은 없었으나, 일정한 수준의 제한적 효과성에 대한 증명이 있는 것으로 확인되었고, 언론층위에서 는 처벌의 강도(양형)를 중심으로 하는 억제전략이 주로 이야기되었으나, 정책층위에서는 억제 및 일반예방전략 모두에 대한 고른 배치가 이루어짐을 확인할 수 있었다. 이를 통해 현재 산업기 술유출에 대한 다층구조상의 일부 불안정성을 확인하였으며, 향후 과제로 억제 및 일반예방전략 의 효과성에 대한 과학적 기준을 반영한 사실적 증명을 지원하는 정책 및 양형논의 외 다른 예방 전략들의 조명 필요성을 제시하였다.
