This article tried to analyze policies on establishing life-long learning act and its revision discussion. The life-long education act is based on rule of law in administration and the legal basis on Korean life-long learning. To seek a fundamental reason for the revision discussion, the article analyzed that why the social education act, the predecessor to the life-long learning act was revised and how the life-long study act, a kind of first draft of life-long learning act was established. Based on this, this article tried to analyze revision background of the current life-long learning and policies on revision contents. Currently, the life-long learning act is introduced to the National Assembly for 2006 all-out revision since its full revision as social education act in 2000. The reason the act needs to be rewritten is that the current life-long learning act does not have the status and authority as parent law and basic law so that it is in name only and also it does not cover the whole life-long learning areas. Therefore, the analysis showed that the act's legal foundation needs to be solidified in order to function well. Moreover, the analysis indicated that there is desperate need for establishing national life-long learning system and its revamping, and nurturing /dispatching experts as human resources for life-long education. Also, the roles of the central and local governments for the education should be enhanced and the legal basis should be established for the life-long learning city, according to the analysis for the background of the revision. The conclusion pointed out that the only fast revision leads to establish the life-long learning education system and stressed the importance of policy implication regarding revision discussion.

이 글에서는 법치행정주의에 입각하여 한국 평생교육의 법제적 기반을 이루는 평생교육법 의 제정 및 개정 논의에 대한 정책적 분석을 시도하고자 하였다. 평생교육법 개정 논의 대두의 근원적 배경으로 평생교육법의 전신인 사회교육법이 당초 평생교육법으로 개정된 배경과 평생교육법의 초안 성격인 평생학습법안의 제정 배경 등을 분석하고 이에 근거하여 현행 평생교육법의 개정 배경과 개정안 구성에 대한 정책적 분석을 시도하였다. 현재 평생교육법은 1999년 8월 사회교육법으로부터 전면 개정된 이후 다시 2006년 전면적인 재 개정안이 국회에 상정되어 있다. 개정안 상정 배경에는 모법이자 기본법으로서의 위상 정립, 국가 평생교육 추진체제의 공고화와 재정비, 평생교육 전문 인력으로서의 평생교육사 배치, 확보 그리고 지역평생교육 활성화를 위한 국가와 지방자치단체의 역할 강화와 평생학습도시 활성화의 법적 근거 마련 등의 배경이 정책적 함의로 작용하고 있음을 분석하였다.
