Private investment projects in the road sector were initially carried out in the form of government notices, but are now being promoted in the form of private proposals. It is necessary to analyze whether private investment projects in the road sector in the form of excessive private proposals are appropriate at the national level. Private investment projects in the road sector are an area where many policies are promoted to strengthen publicity. However, until now, the question has been raised whether the publicity of the road is strengthened by focusing on lowering fares. All of these difficulties arise because it does not specifically stipulate what the publicity of the road is. Roads are important social overhead capital that the state must guarantee in order to guarantee an individual's right to move. The construction and maintenance of roads is a national mission provided by the state to the people, which is divided into a guarantee responsibility to ensure supply and a performance responsibility to bear the implementation. The current private investment project in the road sector led by private proposals only fulfills the state's guarantee responsibility, but there is a problem in its implementation responsibility. Publicity will be secured only when private investment projects are promoted in accordance with the plan for how the state will guarantee and implement road services from the perspective of the entire road network. From this point of view, the public nature of the road can be prepared at the level of national mission only when the two methods of government notice and private proposal are harmonized to some extent.

도로분야 민간투자사업은 초기에 정부고시 형태로 이루어지다가 지금은 민간제안 형태로 추진되고 있다. 지나친 민간제안 형태의 도로 분야 민간투자사업은 국가차원에서 적절한 것인 가에 대한 분석이 필요하다. 도로 분야 민간투자사업은 공공성을 강화하기 위하여 많은 정책 이 추진되는 분야이다. 하지만 지금까지는 요금 인하에 치중하여 도로의 공공성 강화인지 의 문이 제기되고 있다. 이러한 어려움은 모두 도로의 공공성이 무엇인지 구체적으로 규정하지 못하고 있기 때문에 발생하고 있다. 도로는 개인의 이동권 보장차원에서 국가가 보장하여야 하는 중요한 사회간접자본이다. 도로의 건설과 유지관리는 국가가 국민에게 제공하여 하는 국 가임무로, 이는 공급을 보장하는 보장책임과 이행까지 부담하는 이행책임으로 구분된다. 현재 의 민간제안 형태 주도의 도로분야 민간투자사업은 국가가 보장책임만을 이행할 뿐 이행책임 에 있어서 문제가 있다. 국가가 전체 도로 네트워크 관점에서 도로 서비스를 어떻게 보장하고 이행할 것인지에 대한 계획에 따라 민간투자사업이 추진되어야 공공성을 확보할 수 있을 것이 다. 이러한 관점에서 정부고시와 민간제안의 두 가지 방식이 어느 정도 조화를 이루어야 도로 에 대한 공공성을 국가임무 차원에서 마련할 수 있을 것이다.
