SECURITY SERVICES INDUSTRY ACT prohibits security guards to engage in other services than the licensed security services. And if this is violated, the security business license will be revocated. Regarding these provisions, the Constitutional Court acknowledged the legitimacy of the legislative purpose and the appropriateness of the means. However, it was said that it violated the minimum infringement and the balance of legal interests. Therefore, it was decided that it infringed on the security business entity's occupational freedom. However, considering the legislative intent of this regulation, it can be interpreted that the minimum infringement and the balance of legal interests are acknowledged. Therefore, there should be discussions to address the fairness of sanctions and the legislative gap.

이 연구는 “경비원의 비경비업무 수행 금지 및 위반시 경비업 허가 취소 사건”에 대한 헌법재판소의 입장을 분석하는데 목적이 있다. 이 사건에서 헌법재판소는 허가받은 경비업 무 외의 업무에 경비원을 종사하게 하는 것을 금지하고, 이를 위반한 경비업자에 대한 허 가를 취소하도록 정하고 있는 ｢경비업법｣ 관련 규정에 대하여 입법목적의 정당성 및 수단 의 적합성은 인정되나, 침해의 최소성 및 법익의 균형성에 위배되어 경비업자의 직업의 자유를 침해한다고 결정하였다. 그러나 관련 규정의 경우 입법취지를 고려하면, 직업의 자유를 침해할 지라도 침해의 최소성 및 법익의 균형성이 인정된다고 해석할 여지가 있다. 이에 향후 제재의 형평성 및 입법의 공백을 해소하기 위한 개정 논의가 있어야 할 것이라고 제안하였다.
