This paper examines the formation of the legal system for supporting scientific and technological research, focusing on the legislation of the Act on Promotion of the Korea Institute of Science and Technology (KIST Promotion Act) during the establishment of Korea Institute of Science and Technology (KIST). The analysis begins with a review of the policy background that led to the enactment of the KIST Promotion Act, specifically exploring South Korea's science and technology support policies and the influence of U.S. assistance policies. The legislative enactment and amendments of the KIST Promotion Act are then investigated to elucidate the legal issues surrounding the institute's establishment, such as the legal nature of KIST, government contributions, and the free grant of state property. Initially enacted in December 1966, the KIST Promotion Act underwent a swift amendment in March 1967, less than three months later. This highlighted critical issues regarding the independence of the institute and the autonomy of research activities. The provisions finally included in the KIST Promotion Act—such as government contributions, the free grant of state property, required submission of business plans, and audits by certified public accountants—were designed to support KIST’s independence and autonomy while also maintaining necessary oversight mechanisms. These provisions hold significant importance as they formed the legal groundwork for contemporary statutes such as the Act on the Establishment, Operation and Fostering of Government-Funded Research Institutes and the Act on the Establishment, Operation and Fostering of Government-Funded Science and Technology Research Institutes.

본 논문은 ｢한국과학기술연구소육성법｣을 중심으로 한국과학기술연구소 설립을 전 후한 시기 과학기술 연구지원의 법제도 형성 과정을 살펴보았다. 우선 ｢한국과학기술 연구소육성법｣의 입법 배경으로 한국의 과학기술 지원 정책과 미국의 과학기술 원조 정책을 검토하였고, ｢한국과학기술연구소육성법｣의 제정 및 개정 과정을 규명하였다. 이를 바탕으로 한국과학기술연구소의 법적 성격, 정부의 출연금, 국유재산의 무상양여 등의 ｢한국과학기술연구소육성법｣과 관련된 법적 쟁점을 분석하였다. ｢한국과학기술 연구소육성법｣은 1966년 12월 제정되었지만, 제정 3개월여만인 1967년 3월 개정되었 다. 이 갑작스런 개정은 연구소의 독립성과 연구의 자율성이라는 화두를 깊게 던진 것이었다. ｢한국과학기술연구소육성법｣에 최종적으로 규정된 정부의 출연금 지급, 국 유재산의 무상양여, 사업계획서의 보고, 공인회계사의 감사 등의 조항은 연구소의 독 립성·자주성 존중의 전제 위에 나름의 견제 장치를 마련했던 것으로, 현행 ｢정부출연 연구기관 등의 설립·운영 및 육성에 관한 법률｣, ｢과학기술분야 정부출연연구기관 등의 설립·운영 및 육성에 관한 법률｣ 등에 규정되어 있는 과학기술 연구지원 관련 조항의 원형이 되었다는 점에서 중요한 의의를 갖는다.
