The special judicial police system was introduced to overcome the limitations of general judicial police expertise in special fields along with the rapid increase in various administrative crimes due to social development, and to quickly cope with related crimes based on the expertise required in special administrative areas. Currently, the scope and number of employees are continuously expanding. However, the special judicial police are absolutely short of education and training time for investigative ability due to frequent movements and other administrative tasks. The reality is that there are no educational obligations and there are not enough opportunities for conservative education. On the other hand, major foreign countries are continuously maintaining and strengthening efforts to secure the function of the special judicial police system, such as operating various professional programs and independent training institutions. In Germany, for example, about 148 programs are operated by the German Judicial Research and Training Institute, and in the United States, the Federal Law Enforcement Training Center (FLETC) is in charge of basic education in addition to the diversity of educational institutions for special judicial police. The educational content is also systematic, such as basic education, in-depth training courses, and practical training such as driving and firearms. Education and retraining are important in any organization. In particular, the activation of the function of the special judicial police through the improvement of investigation ability in the special judicial police should not be neglected in relation to human rights issues as well as the law of evidence in the litigation process. However, in Korea, it is difficult to expect the expertise and effectiveness of special judicial police due to the lack of related laws to strengthen investigation capabilities and the lack of plans with the agency in charge of education and training. In the following, focusing on these points, we will try to obtain implications for Korea through comparison with major foreign countries and explore Korea's own plans based on this.

특별사법경찰제도는 사회발전에 따른 각종 행정범죄의 급격한 증가와 함께 일반사 법경찰의 특수 분야에 대한 전문성의 한계를 극복하고, 특수한 행정영역에서 요구되는 전문지식을 바탕으로 관련 범죄에 신속하게 대처하기 위하여 도입되었고 현재 지속적 으로 그 직무범위와 인원이 확대되고 있다. 그러나 특별사법경찰은 순환보직에 따른 잦은 이동과 행정업무 겸업 등으로 수사능력을 향상시킬 교육훈련 시간이 절대적으로 부족한 상황에서 특별사법경찰 지명 후 교육의무도 없으며, 수사능력 향상을 위한 보 수교육 기회도 충분하지 않은 것이 현실이다. 이에 반하여 주요 외국의 경우 다양하고 전문적인 프로그램과 독자적 훈련교육기관 을 운용하고 있는 등 특별사법경찰제도의 기능이 확보할 수 있는 노력을 지속적으로 유지·강화하고 있다. 가령 독일의 경우 독일법관연수원에서 약 148개의 프로그램을 운용하고 있으며, 미국의 경우 특별사법경찰을 위한 교육기관 자체의 다양성에 더하여 대표적으로 연방사법연수원(Federal Law Enforcement Training Center, FLETC)에서 기본적 교육을 담당하고 있다. 그 교육내용도 기본교육, 심화훈련과정, 운전 및 총기와 같은 실무훈련 등 체계화되어 있다. 어느 조직이든 교육과 재교육훈련은 중요하다. 특히 특별사법경찰에 있어 수사능력 향상을 통한 특별사법경찰의 기능 활성화는 인권문제는 물론 소송과정 상의 증거법칙등과 관련하여서도 소홀해서는 안 된다. 그러나 우리나라의 경우는 수사 역량 강화를 위한 관련 법령의 부재, 교육훈련 주관기관과 계획의 부재 등으로 인하여 특별사법경 찰의 전문성 및 실효성을 기대하기 어려운 실정이다. 이하에서는 이러한 점에 착안하 여 주요 외국과의 비교를 통하여 우리나라에 시사점을 얻고 이를 바탕으로 우리나라 나름의 방안을 모색해 보고자 한다.
