Borderline intellectual disability’, who have difficulties in cognitive, social, and decision-making abilities, are bound to be controversial issues regarding whether life-sustaining treatment should be continued or discontinued under the Lifesustaining Treatment Decision-Making Act. This paper seeks to understand the limitations they experience in life-sustaining treatment decisions by clearly identifying the characteristics and legal status of borderline intellectual disability, and to examine legal deficiencies to seek improvement measures that guarantee their participation and respect their autonomy and dignity. Borderline intellectual disability, for which there is no clear legal definition, is a special group with limited decision-making ability but who can express a certain level of will. The current Life-sustaining Treatment Decision-Making Act does not sufficiently reflect their characteristics. This does not sufficiently guarantee the dignity, autonomy, and best interests of borderline intellectual disability. Unlike general patients, people with borderline intelligence require special support in communication and decision-making processes. Therefore, considering their special characteristics, the Life-Sustaining Treatment Decision Act should be revised to increase effectiveness and ensure quality of life and dignity. To this end, a decision-making support system should be introduced, their rights should be actively protected by professional guardians, etc., and active intervention by the Medical Institution Ethics Committee is necessary. Finally, the so-called ‘Law on the Protection and Support of the Rights of People with Borderline Intelligence’ should be enacted and implemented as soon as possible, and the rights of people with borderline intelligence and national support related to medical care that were excluded from the bill should be included.

인지적, 사회적, 그리고 의사결정 능력에서 어려움을 겪는 ‘경계선지능인’은 연명의료 결정법상 연명의료를 지속 또는 중단해야 할지 등에 관한 사항은 논쟁이 될 수밖에 없는 사안이다. 본 논문은 경계선지능인의 특성과 법적 지위를 명확히 규명하여 이들이 연명 의료 결정 등에서 겪는 한계를 이해하고, 법적 미비점을 고찰함으로서 그들의 참여 보장 및 자율성과 존엄성을 존중하는 개선 방안을 모색하였다. 명확한 법적 정의가 없는 경계선지능인은 의사결정 능력이 제한적이지만 일정 수준의 의사를 표현할 수 있는 특수한 집단으로, 현행 연명의료결정법은 이들의 특성을 충분히 반영하지 못하고 있다. 이는 경계선지능인의 존엄성, 자율성, 그리고 최선의 이익을 충분 히 보장하고 있지 못하다. 경계선지능인은 일반 환자와 달리 의사소통과 의사결정 과정에서 특별한 지원을 필요 로 한다. 따라서 이들의 특수성을 고려한 제도적 변화는 연명의료결정법의 실효성을 높 이고, 삶의 질과 존엄성을 보장해하는 측면으로 개정되어야 한다. 이를 위해 의사결정 지원 제도를 도입해야 하며, 전문성 있는 후견인 등으로부터 적극 보호받아야 하고, 의료 기관윤리위원회의 적극적 개입이 필요하다. 끝으로 소위 ‘경계선지능인 권리보장 및 지 원에 관한 법률안’ 등이 조속히 제정 및 시행되어야 하며, 법률안에서 제외되었던 의료와 관련한 경계선지능인의 권리와 국가적 지원 등이 포함되어야 한다.
