Drug crimes are also on the rise worldwide. Such drug crimes have spread indiscriminately throughout the world through organizationalization and sophistication, and have become a risk factor for the international community that cannot be dealt with by the efforts of a country alone. In Korea, drug crimes are also on the rise, with 27,611 drug offenders in 2023. The current treatment and rehabilitation system should be used more actively to prevent recidivism of drug offenders, especially youth drug offenders. The suspension system for conditional prosecution of drug offenders is a key part of this change. Through this system, criminals will be able to receive treatment and rehabilitation in society instead of punishment. This study aimed to suggest ways to improve the conditional grace system for prosecution of drug offenders in various ways. In particular, the three conditional suspensions of prosecution centered on the Korean Association Against Drug Abuse, conditional suspension of prosecution for completion of education, probation office, and judicial-treatment-rehabilitation model participation, were reviewed and proposed. Specifically, it is necessary to clarify legal grounds, specialize-characterize program operation, increase and realize program budgets, and strengthen other manpower and education and training as a way to improve the conditional suspensions of prosecution system for drug offenders.

전 세계적으로도 마약류 범죄는 급증하고 있다. 이러한 마약류 범죄는 조직화·첨단화로 인해 무차별적으로 확산되어 어느 한 국가의 노력만으로 대응할 수 없는 국제사회의 위험요 인이 되었다. 우리나라 또한 2023년 마약 범죄자가 27,611명에 달하는 등 마약류 범죄가 증 가하고 있다. 특히 청소년 마약사범의 재범을 막기 위해 현행 치료 및 재활 시스템을 더욱 적 극적으로 활용해야 할 것이다. 마약류 범죄자에 대한 조건부 기소유예 제도는 이러한 변화의 핵심적인 부분이라 할 수 있다. 이 제도를 통해 범죄자는 처벌 대신 사회에서 치료와 재활을 받을 수 있을 것이다. 본 연구는 마약사범에 대한 조건부 기소유예 제도를 다양한 측면에서 개선할 수 있는 방안을 제시하는 것을 목표로 하였다. 특히 한국마약퇴치운동본부를 중심으 로 하여 이뤄지고 있는 3가지 조건부 기소유예제도인 교육이수조건부 기소유예, 보호관찰소 선도조건부 기소유예, 사법-치료-재활 연계모델 참여조건부 기소유예 프로그램의 내용을 고 찰하여 그 문제점과 개선방안을 제시하였다. 구체적으로 마약류 사범에 대한 조건부 기소유 예 제도 개선 방안에는 법적 근거 명확화, 프로그램 운영 전문화-특성화, 프로그램 예산 증 액 및 현실화, 기타 인력 확보와 교육 및 훈련 강화가 필요하다.
