Children separated from their guardians due to domestic abuse, violence, or family dissolution experience various challenges, including psychological instability and economic difficulties. In particular, the infringement of their right to education hinders their academic continuity and self-reliance, posing a significant obstacle to social integration. This study aims to explore improvement measures to ensure the educational rights of out-of-home youth by expanding their academic opportunities and providing a stable learning environment. For this purpose, the study compares and analyzes relevant policies and support programs in South Korea and Japan. The research method involved a literature review of the laws, policy documents, and support programs of both countries. The findings are as follows: In South Korea, based on the Youth Welfare Support Act, youth shelters and out-of-school youth support centers link formal education with alternative education and operate customized education programs utilizing smart classrooms. In Japan, under the Act on Securing Educational Opportunities, flexible learning environments are provided through initiatives such as free schools (privately operated learning facilities that do not confer formal academic credentials but offer tailored learning support and emotional assistance), night schools, and IT-based learning programs. Based on this analysis, the study suggests the need for an integrated approach that harmoniously combines public education systems with flexible learning opportunities to ensure the educational rights of out-of-home youth.

가정 내 학대, 폭력, 가정해체 등으로 인해 보호자로부터 분리된 가정 밖 청소년은 심리적 불 안정과 경제적 어려움 등 다양한 문제를 겪는다. 특히 교육권 침해는 이들의 학업 지속과 자립을 저해하며, 사회 통합에도 큰 장애 요인으로 작용한다. 이에 본 연구에서는 가정 밖 청소년의 교 육권 보장을 중심으로, 학업 기회를 확대하고 안정적인 학습 환경을 제공하기 위한 개선 방안을 모색하고자 한다. 이를 위해 한국과 일본의 관련 정책 및 지원 사업을 비교⋅분석하였다. 분석 결과는 다음과 같다. 한국은 ｢청소년복지지원법｣을 기반으로 청소년 쉼터와 학교밖청소년지원센터 를 통해 정규교육과 대안교육을 연계하고, 스마트 교실을 활용한 맞춤형 교육 프로그램을 운영하 고 있다. 일본은 ｢교육기회확보법｣을 기반으로 정규 학력으로 인정되지 않지만 맞춤형 학습과 정 서적 지지를 제공하는 민간 주도의 학습 시설인 프리스쿨, 야간학교, IT 기반 학습 프로그램 등 을 통해 유연한 학습 환경을 조성하고 있다. 이러한 분석을 바탕으로, 가정 밖 청소년의 교육권 보장을 위한 방안을 제안하였다.
