The purpose of this study is to analyze how the principle of separation of powers, which is the core content of the constitutional government structure theory, has been applied in the curriculum, identify implications through this, and derive directions for improvement. To this end, the functions and content elements of the principle of separation of powers were identified, and the criteria for analysis were set based on this, and the contents of the principle of separation of powers were analyzed from the social studies teaching syllabus to the 2022 revised social studies curriculum. As a result of this study, the educational implications of the principle of separation of powers are that the reflection of the content elements of the principle of separation of powers has expanded, and while arranging grades to avoid duplication of the content of the principle of separation of powers, the content element ‘checks and balances’ has been approached in high school, and has changed to reflect elements of law-related education along with political education. Based on these implications, the following should be improved in the current curriculum. First, the political education and law-related education aspects of the principle of separation of powers education in the social studies curriculum should be systematically approached by school level. Second, the functions and content elements of the principle of separation of powers in the social studies curriculum should be arranged in a balanced manner by school level and not be biased overall. Third, the content element of the principle of separation of powers, ‘authority stipulated in the Constitution,’ should be utilized to promote harmony between political education and law-related education. Fourth, the content of the principle of separation of powers in the social studies curriculum should be designed based on ‘separation of powers’ and other content elements should be gradually expanded in scope according to school level. Fifth, high school elective courses should reflect the functions and content elements of the principle of separation of powers according to the characteristics of the course, thereby avoiding duplication of content between the elective courses. Sixth, the ‘checks and balances’ element that has been continuously applied in high schools should be reflected in the achievement standards of the elective course ‘Law and Society’.

현대 사회에서 헌법의 기본원리에 대한 소양이 필요하고 이를 위해 헌법교육의 필요성이 심화 되고 있으나, 헌법교육에서 통치구조론 교육에 대한 부정적인 견해가 있어 왔다. 이 연구에서는 헌 법 통치구조론의 핵심 내용인 권력분립원리가 그동안의 교육과정에서 어떻게 적용되어 왔는지를 분석해 보고 이를 통해 시사점을 확인하여 그 개선 방향을 도출해 보고자 하였다. 이를 위해 권력 분립원리의 기능과 내용 요소를 확인하고 이를 토대로 분석의 기준을 설정하여 사회생활과 교수요 목부터 2022 개정 사회과 교육과정에 이르기까지 권력분립원리에 관한 내용을 분석하였다. 이 연 구의 결과로서 시사점은 권력분립원리의 내용 요소가 확대 반영되어 왔고, 권력분립원리의 학교급 내에서의 중복을 피하도록 내용 배열을 해 왔으며, 내용 요소 ‘견제와 균형’은 고등학교에서의 적용에 적절하다는 것이었다. 그리고 정치교육과 법교육을 동시에 접근할 수 있는 방식으로 변화해 왔다는 것이었다. 이러한 시사점에 터하여 현행 교육과정에서 개선되어야 할 점은 다음과 같다. 첫째, 사회과 교육과정에서 권력분립원리 교육의 정치교육 및 법교육 측면을 학교급 별로 체계 화하여 접근하여야 한다. 둘째, 사회과 교육과정에서 권력분리원리의 기능 및 내용 요소를 학교급 별로 균형 있게 전체적 으로는 치우치지 않게 배열하여야 한다. 셋째, 권력분립원리의 내용 요소인 ‘헌법에 규정된 권한’을 활용하여 정치교육과 법교육의 조화 를 도모하여야 한다. 넷째, 사회과 교육과정에서 권력분립원리에 관한 내용은 ‘권력의 분리’를 기본으로 하여 다른 내용 요소들이 학교급에 따라 그 범위가 점차 확장되도록 설계되어야 한다. 다섯째, 고등학교 선택 과목은 과목 특성에 맞게 권력분립원리의 기능과 내용 요소를 반영하여 선택 과목 간 내용의 중복을 피하도록 한다. 여섯째, 고등학교에서 지속적으로 적용되어 온 ‘견제와 균형’ 요소가 선택 과목 ‘법과 사회’의 성취기준에 반영되어야 한다.
