This study aims to provide implications for future policies to protect teachers’ legitimate educational activities by analyzing the revision process of the ‘Five Laws to Protect Teachers’Education Rights’ based on Kingdon’s policy stream model. Specifically, Kingdon's policy stream model was applied to the revision process of the ‘Five Laws to Protect Teachers’Education Rights’ to examine the problem stream, the political stream, the policy stream. Focusing on this, the events and opportunities that opened the policy window were analyzed, and the activities of the major policy entrepreneurs who influenced the direction of policy decisions were analyzed. According to the results of this study, first, there is a clear incident called the ‘Seoi Elementary School Incident’ in the problem stream, and this served as a major opportunity to open the policy window. In addition, the formation of national consensus through social issues was combined with the strong political stream. Second, it was found that there is a lack of the policy stream related to the revision of the ‘Five Laws to Protect Teachers’Education Rights’. Third, in the process of revising the ‘Five Laws to Protect Teachers’Education Rights’ policy entrepreneurs were identified as teachers’ organizations, the Ministry of Education, and members of the National Assembly. In addition, contrary to previous studies on teachers’ rights protection policies, the role of policy entrepreneurs was found to have a significant impact in the process of revising the ‘Five Laws to Protect Teachers’Education Rights’. Based on these research results, implications for establishing effective teachers’ rights protection policies in the future were presented.

이 연구는 Kingdon의 정책흐름모형을 기반으로 ‘교권 보호 5법’의 개정 과정을 분석하여, 향후 교사의 정당한 교육 활동 보호 정책을 위한 시사점을 제공하는 데 목적이 있다. 이를 위해, ‘교권 보호 5법’ 개정 과정에 Kingdon의 정책흐름모형을 적용하여 정책문제의 흐름, 정치의 흐름, 정책 대안의 흐름을 살펴보았다. 이를 중심으로 정책의 창이 열리게 된 사건 및 계기를 분석하고 정책 결정 방향에 영향을 미치는 주요 정책활동가의 활동을 분석하였다. 이 연구의 결과에 따르면, 첫째, 정책문제의 흐름에 ‘서이초 사건’이라는 명확한 사건이 존재하며, 이는 정책의 창이 열리는 주요 계기로 작용하였다. 더불어 사회적 이슈를 통한 국민적 공감대 형성은 강력한 정치의 흐름과도 결합하였다. 둘째, ‘교권 보호 5법’ 개정과 관련한 정책대안의 흐름이 부족한 것으로 나타났다. 셋째, ‘교권 보호 5법’ 개정 과정에서 정책활동가는 교직단체, 교육부, 국회의원으로 나타났다. 또한 교권 보호 정책 관련 선행연구와 반대되는 결과로 ‘교권 보호 5법’의 개정 과정에서는 정책활동가의 역할이 큰 영향을 끼치는 것으로 나타났다. 이러한 연구 결과를 토대로 향후 효율적인 교권 보호 정책 수립을 위한 시사점을 제시하였다.
