In July 2023, the Screen Actors Guild-American Federation of Television and Radio Artists (SAG-AFTRA) undertook the longest strike in Hollywood's history in response to serious violations of rights arising from the unauthorized replication and reuse of performers' voices, likenesses, and performances through artificial intelligence technology. After a protracted strike lasting 118 days, an agreement was reached with producers, recognizing the performers' right to consent. The advancement of artificial intelligence has enabled the creation and manipulation of highly realistic digital reproductions of individuals' likenesses, images, and voices. As a result, the economic and personal rights of these individuals are being severely infringed upon, and the existing legal framework is inadequate to protect these rights. Digital replicas, in particular, present more severe challenges than traditional infringements of publicity rights. These replicas can reproduce individuals with remarkable accuracy and can emulate their abilities and actions, effectively replacing the actual person. This situation places performers at risk of competing in the marketplace against their own digital reproductions. In light of the new legal issues arising from the digitalization of personal personas due to advancements in AI technology, there is active discussion in the United States regarding the establishment of federal legislation to grant individuals the right to directly control the creation and use of digital replicas of their persona, referred to as digital replication rights. This paper aims to examine the necessity of implementing digital replica rights as a protective measure for performers facing unprecedented challenges posed by advancements in artificial intelligence technology.
