This study analyzed the level of welfare ordinance legislation based on the premise that the accumulated time of ordinance legislation and the local council's policy support system have led to expectations of professionalism in this area. The research examined the current status and requirements for enacting welfare ordinances. To achieve this, welfare ordinances enacted in Incheon Metropolitan City Hall and ten cities and counties within Incheon Metropolitan City were analyzed from July 1, 2022, to June 30, 2024, covering the first half of the 8th civil election and the 9th local council. The results indicated that Incheon's total welfare ordinance enactment accounted for 194 cases, approximately 32% of the total ordinance enactment of 606 cases. There were only fiveunique autonomous welfare ordinances nationwide, constituting about 2.6% of the total welfare ordinances, suggesting that approximately 97.4% were imitative. Additionally, there were 29 unique welfare ordinances within the Incheon region, making up about 15% of the total welfare ordinances, along with 16 diffused welfare ordinances, which accounted for approximately 8.3% of the total. Unlike in the past, many ordinances that provide practical benefits to local residents were being enacted, and it was challenging to identify characteristics according to the party affiliations of those who proposed the ordinances. Based on the study's findings, it is suggested that when enacting welfare ordinances, there is a need to create innovative ordinances that leverage regionalcharacteristics, utilize the proposer's experience effectively, and approach the process with heightened sensitivity to the local community.

본 연구는 그동안 조례입법의 축적 시간과 지방의회 정책지원관 제도로 인하여 조례입법의 전문성을 기대하게 되었다는 전제에 따라 복지조례 입법 수준을 분석하여 그 현황과 복지조례 입법 시 필요한 것이 무엇인지 살펴보았다. 이를 위해서 민선 8기 및 지방의회 9기의 전반기에 해당하는 2022년 7월 1일부터 2024년 6월 30일까지의 기간을 한정하여 인천광역시 본청 및 인천광역시 10개 군·구에 제정된 복지조례를 분석하였다. 연구 결과, 인천의 전체 복지조례 제정은 194건으로 전체 조례제정 606건 대비 약 32%를 차지하였고, 전국에서 유일한 자치복지조례는 5건으로 전체 복지조례 대비 약 2.6%만을 차지하여 약 97.4%는 모방한 복지조례로 나타났다. 그리고 인천지역 내 유일 복지조례는 29건으로 전체 복지조례 대비 약 15%, 확산한 복지조례는 16건으로 전체 복지조례 대비 약 8.3%를 차지하였다. 그리고 제정된 복지조례들이 과거와는 달리 지역주민에게 실질적인 이익을 줄 수 있는 조례들이 많이 제정되고 있었으며, 조례를 발의한 자들의 정당 차이에 따른 특성은 찾기 어려웠다. 연구 결과에 따라 복지조례 입법 시 지역의 특성을 살린 창의적 복지조례 제정이 필요하며, 발의자의 경험등을 충분히 살릴 뿐만 아니라 지역사회에 반응하는 민감도를 높여 접근할 필요가 있음을 제언하였다.
