The objective of this study is to provide empirical evidence to support the development of practical interventions by examining the experiences of family members of suspects with intellectual disabilities within the criminal justice system. In-depth interviews were conducted with five family members who have participated in the criminal justice process involving an adult suspect with intellectual disabilities. The inductive analysis, of the qualitative data resulted in the identification of 18 meaning units, 7 subcategories, and 3 primary categories through thematic analysis. The three core categories identified were: The first category is 'Involvement in criminal incidents due to the characteristics of the person with intellectual disabilities,' The second category is 'Experiencing exclusion during the judicial process,' The third category is 'Shouldering the burden of dual responsibilities in resolving the incident and caregiving as a family member of a suspect with intellectual disabilities.' In light of these findings, we have proposed improvements to effectively safeguard the procedural rights of suspects with intellectual disabilities and alleviate the caregiving burden on family members.

본 연구는 지적장애인 피의자 가족구성원의 형사절차 참여경험을 탐색함으로써 실증적 개입의 근거를 마련할 목적으로 수행되었다. 이를 위하여 성인 지적장애인 피의자의 가족구성원 중 형사절차 참여경험이 있는 연구참여자 5명을 대상으로 심층면접을 수행하였고, 질적자료를 귀납적으로 분석하여 범주화된 의미 를 도출하는 주제분석을 실시하였다. 분석결과, 18개의 의미단위, 7개의 하위범주, 3개의 범주가 도출되었 다. 핵심범주인 3개의 범주는 ‘지적장애인의 특성으로 인해 범죄사건에 연루됨’, ‘형사절차 참여과정에서 배제를 경험함’, ‘지적장애인 피의자의 가족이기에 사건수습과 돌봄의 이중 역할을 감당함’으로 나타났다. 위 결과를 바탕으로 지적장애인 피의자의 절차적 권리를 실질적으로 보장하고 가족구성원의 돌봄부담을 완 화할 수 있는 개선방향을 제안하였다.
