As the commercialization of Maritime Autonomous Surface Ship in the ocean approaches, the scope of the Korea Coast Guard's mission is expected to expand. For this reason, it is essential to analyze the applicability and limitations of the Korean Coast Guard Act, which was enacted to solidify the legal basis for the performance of the Korea Coast Guard's mission to secure maritime safety and public order. Accordingly, this researcher reviewed the problems that may arise in the application of the Korean Coast Guard Act when the commercialization of Maritime Autonomous Surface Ship is realized. In particular, at a time when international standards related to Maritime Autonomous Surface Ship have not been established, there are very high doubts about the applicability of Article 12 (Maritime Inspection and Search), Article 13 (Tracking and Seizure), and Article 14 (Maritime Navigation Protection Measures) of the current Korean Coast Guard Act, which were enacted as regulatory provisions for manned ships. Therefore, based on the issues identified through this awareness, we intend to further solidify the legal basis for supporting the efficient safety management and control of autonomous vessels by the Korea Coast Guard by revising the ‘Definition of Terms’ and ‘Scope of Application’ specified in the Korean Coast Guard Act, as well as suggesting new measures that take into account the special characteristics of unmanned vessels such as the ‘remote inspection system’ and ‘emergency control authority’.

해양에서 자율운항선박의 상용화 시기가 가까워짐에 따라 해양경찰의 임무 범위 는 확대될 것으로 보인다. 이러한 이유로 해양 안전과 치안 확보를 위한 해양경찰 임무 수행의 법적 근거를 확고히 하기 위해 제정된 ｢해양경비법｣의 적용 가능성과 한계에 대한 분석은 필수적이다. 이에 본 연구자는 자율운항선박의 상용화가 실현되 었을 경우 ｢해양경비법｣을 적용함에 있어 발생할 수 있는 문제점들을 검토하였다. 특히 자율운항선박과 관련된 국제적 기준이 마련되지 않은 시점에서 유인 선박에 대 한 규제 조항으로 제정된 현행 ｢해양경비법｣ 제12조(해상검문검색), 제13조(추적 및 나포), 제14조(해상 항행 보호조치)의 적용 가능성에 대한 의문은 매우 높다고 할 것 이다. 따라서 이러한 문제의식을 통해 도출된 사항들을 중심으로 자율운항선박에 대 한 해양경찰의 효율적인 안전관리 및 통제를 뒷받침하기 위한 법적 근거를 더욱 확 고히 하고자 ｢해양경비법｣에 명시된 ‘용어의 정의’, ‘적용 범위’의 개정은 물론 ‘원격 검문시스템’, ‘비상 통제권’ 등의 무인화 특수성을 고려한 신설 방안을 제시하고자 한다.
