In this study, I reviewed the historical development of the principle of separation of powers, and examined its practical implications, new directions, and contents in the contemporary situation. I also examined the problems and limitations of the power control devices in Korean constitutional practice, and based on this, I explored constitutional countermeasures to actualize the principle of separation of powers in the future. Recently, our society is facing serious threats to the existence of human communities and the value of human existence due to severe climate change, rapidly declining birth rates, and the emergence of generative artificial intelligence. In addition, with the entry of the super-elderly society, difficult tasks such as creating jobs for the elderly, expanding the care benefit system, and reforming public pensions are waiting for the state to play an active role. These recent developments require us to look at the principle of separation of powers from a new perspective that is far different from the traditional separation of state functions. In order to respond immediately and proactively to the serious threats facing individuals and communities, the state must be able to effectively mobilize all the capabilities and resources of the state in an emergency to ensure the right to life, secure the safety of citizens, and preserve the existence of communities. However, once consolidated, power tends to stay consolidated, and there is a risk that it will soon become a mechanism to suppress human freedoms and monitor civil society. It is necessary to ensure that the functions of the state can be organically combined and utilized in a unified manner during emergencies, but with the resilience to revert to the decentralized powers of the past as soon as normalcy returns.

본 연구에서는 권력분립원리의 역사적 전개를 살펴보고 현대적 상황에서 그것이 갖 는 실천적 함의와 새로운 지향점에 대해 검토하였다. 그리고 우리나라 헌정 실제에 있어서 권력통제의 장치들이 노출하고 있는 문제점과 한계를 짚어보고, 이를 토대로 향후 권력분립원리를 실질화하기 위한 헌법적 대응방안을 모색해보았다. 최근 우리 사회는 심각한 고령화, 저출생, 기후 변화 등으로 인하여 인류공동체의 존립과 인간의 존재가치를 심각하게 위협하고 있다. 특히 초고령사회의 진입에 따라 노인의 일자리 창출과 요양급여 제도의 확충, 공적 연금의 개혁 등이 어려운 과제들이 국가의 적극적 역할을 기다리고 있다. 이러한 최근의 상황은 전통적인 국가기능의 분리와는 차원이 다른 새로운 관점에서 권력분립의 원리를 바라보게 한다. 즉 개인과 공동체가 직면한 심각한 위협에 즉각적 이고 능동적으로 대처하기 위해 국가는 국민의 생존권 보장, 시민의 안전 확보, 공동체 의 존속 등에 필요한 국가의 모든 역량과 자원을 비상시 효과적으로 결집시킬 수 있어 야 한다. 이에 우리는 사회의 복지와 안전에 대해 총체적 책임을 다하는 국가의 현대적 과제 를 효과적으로 수행할 수 있도록 권력분립의 원리를 새롭게 모색해야 하는 과제를 안 고 있다. 여기서 입법·행정·사법의 기능을 보다 전문적이고 효율적으로 수행할 수 있도록 각 부처를 조직화하면서, 이를 통해 입법부·행정부·사법부가 상호 견제와 협 조 속에서 각자의 역량을 극대화하는 것이 무엇보다 중요하다. 이에 따라 권력분립원리는 점차 권력구조 내에서의 수직적 분권과 권력 상호간의 수평적 협치를 동시에 추 구하는 방향으로 진화해가고 있다. 하지만 한 번 결집된 권력은 잘 흩어지지 않는 속성이 있기 때문에 머잖아 인간의 자유를 억압하고 시민사회를 감시하는 기제로 작용할 위험이 있다. 유사시 국가의 기 능들을 유기적으로 결합하여 통합적으로 활용할 수 있게 하면서도, 평상시로 돌아가면 즉시 과거의 분산된 권력으로 회귀하려는 복원력을 갖추게 할 필요가 있다. 이러한 맥락에서 권력분립원리는 또 다른 의미와 방향성을 확보할 수 있을 것이다.
