With the advent of the digital hyper-connected society caused by the 4th industrial revolution, sexual crimes and human rights violations using information and communication technology are emerging as major social problems. Accordingly, in order to respond to these problems, the government announced the government-wide comprehensive digital sex crime damage prevention plan on September 26 of the same year when revenge porn emerged as a social problem in 2017. The problem was pointed out as the fundamental cause of illegal video distribution, and in January 2019, web hard cartel prevention measures were prepared to eradicate illegal pornography distribution. has come to announcing Nevertheless, in line with the continuous occurrence of more powerful and sophisticated digital sex crimes against children and adolescents due to the occurrence of the 'L-Bunbang incident' in 2022, the current government is conducting the Ministry of Justice and Ministry of Gender Equality and Family under the supervision of the Korea Communications Commission for the 'right to be forgotten' of victims of digital sex crimes. Next, it is necessary to provide customized services to victims of digital sex crimes by strengthening the capabilities of the digital sex crime victim support service organization and expanding the response center. Lastly, it is necessary to review the legislative precedents of Germany and the United States to actively consider whether to introduce a search and seizure system and a digital probation system in criminal law. If these measures are actively converged, the digital sex crime victim support system will be much more developed than it is now, and the pain of victims will be relieved a little. In order to respond to rapidly developing digital sex crimes, a better digital sex crime victim support system should be prepared through convergence research on the current law, system, and digital technology.

4차 산업혁명으로 인한 디지털 초연결사회의 도래에 따라 정보통신 기술을 이용한 성범죄 및 인권침해가 사회의 큰 문제로 부각되고 있 다. 이에 따라 정부는 이러한 문제에 대응하기 위해 2017년 리벤지 포르노가 사회적 문제로 대두되자 동년 9월 26일 범정부 디지털 성범 죄 피해방지 종합대책을 발표하였고 2018년에는 웹하드·필터링·디지 털 장의업체 간 형성된 카르텔 문제가 불법영상물 유통의 근본적인 원 인으로 지목되어 2019년 1월에는 불법음란물 유통 근절을 위한 웹하 드 카르텔 방지 대책을 마련하였으며 2020년에는 ’N번 방 사건‘으로 인해 동년 4월 23일 디지털 성범죄 근절대책을 발표하기에 이르렀다. 그럼에도 불구하고 2022년 'L번 방 사건’ 발생으로 인해 보다 더 강력하고 정교한 아동 청소년 대상 디지털성범죄의 지속적인 발생에 따라 현 정부는 디지털성범죄 피해자의 ‘잊힐 권리’를 위해 방송통신위 원회 주관으로 법무부·여성가족부·대검찰청·경찰청·방송통신심의위원회 등 정부 및 유관기관 관계자, 카카오·구글·메타 등 주요 인터넷사업자 임원, 학계·법조계 전문가 등을 참석하게 하여 디지털성범죄 2차 피해 를 막을 수 있도록 피해자 중심의 지원체계를 만들기 위한 협력을 지 속적으로 추진하고 있다. 이에 따라 디지털 성범죄 피해자 지원체계를 좀 더 발전시키기 위해 서 다음과 같은 몇 가지의 발전방안들을 검토한다면 디지털 성범죄 피 해자들의 고통을 좀 더 덜 수 있는 계기가 될 것이다. 우선 디지털 성 범죄 근절을 위한 정보통신기술들을 더욱 발전시켜 지속적으로 활용해 야 할 것이다. 디지털 범죄자 모니터링 시스템의 도입 및 AI·필터링 기술을 활용한 불법영상 유포 및 확산차단 서비스 구축, 그리고 성범 죄 피해 초기상담 및 증거관리에 대한 플랫폼 구축이다. 다음으로 디 지털 성범죄 피해지원 서비스 실행조직의 역량강화 및 대응센터 확대로 디지털 성범죄 피해자들에게 맞춤형 서비스를 제공해야 한다. 마지 막으로 독일 및 미국의 입법례 등을 검토하여 형사법상 압수수색제도 와 디지털 보호관찰제도 도입여부를 적극 검토할 필요가 있다. 이러한 방안들이 적극 수렴된다면 디지털성범죄 피해자 지원체계는 지금보다 훨씬 발전하게 될 것이며 피해자들의 아픔을 조금이나마 덜 어줄 수 있을 것이다. 빠르게 발전하고 있는 디지털 성범죄에 대응하 기 위해 지금의 법과 제도, 디지털 기술의 융합적 연구를 통해 더 나 은 디지털성범죄 피해자 지원체계를 마련해야 할 것이다.
