The period from the Korean Empire to the early Japanese colonial era marked the beginning of modernization in Korean medicine. The changes in medical legislation during this time formed the foundation of the future Korean medical system. This study aims to analyze the content of relevant laws, including the 1900 Medical Practitioner (醫士) Regulations, the 1913 Physician (醫師) Regulations, the Traditional Medicine Practitioner Regulations, and the Dentist Regulations, interpreting them in relation to the social and political context of the time, and ultimately examining their influence on the formation of the modern Korean medical system. The 1900 Medical Practitioner Regulations of the Korean Empire showed an integrated approach encompassing both Western medicine and traditional Korean medicine. This reflected the intention to recognize the status of traditional medicine even in the process of modernization. The 1913 Physician Regulations, enacted by the Japanese colonial government, excluded traditional Korean medicine practitioners from the category of physicians and introduced a dualistic policy of managing them through separate Traditional Medicine Practitioner Regulations. This signified a reorganization of medical policy centered on Western medicine. The so-called ‘three medical regulations system’, consisting of the Physician Regulations, Traditional Medicine Practitioner Regulations, and Dentist Regulations, provided a basic framework for medical practitioners' qualifications, scope of work, and roles by profession, which later became the foundation of Korean medical law. In conclusion, the changes in medical legislation during the late Korean Empire and early Japanese colonial period marked a significant turning point in the formation of the modern Korean medical system. The legislation of this period reflected not only changes in the medical system but also social, cultural, and political changes. In particular, the re-establishment of the relationship between traditional Korean medicine and Western medicine, and the establishment of a qualification management system for medical practitioners can be seen as forming the basis of the modern Korean medical system.

대한제국부터 일제강점기 초기에 이르는 시기는 한국 의료의 근대화가 본격화되는 시기로, 이 시기의 의료 법제 변화는 향후 한국 의료 체계의 근간을 형성했다. 본 연구는 1900년 의사(醫士)규칙, 1913년 의사(醫師)규칙, 의생규칙, 치과의사규칙 등 관련 법령 의 내용을 분석하고, 이를 당시의 사회적, 정치적 맥락과 연관 지어 해석하여, 궁극적으로 한국 근대 의료 체계의 형성에 미친 영향을 고찰하는 것을 그 목적으로 한다. 1900년 대한제국의 의사(醫士)규칙은 서양의학과 한의학을 모두 포괄하는 통합적 접근을 보여주었다. 이는 근대화 과정에서도 전통의학의 지위를 인정하려는 의도를 반 영한다. 1913년 일제에 의해 제정된 의사(醫師)규칙은 한의사를 의사의 범주에서 제외 하고, 이를 별도의 의생규칙을 통해 관리하는 이원화 정책을 도입했다. 이는 서양의학 중심의 의료 정책 재편을 의미한다. 의사규칙, 의생규칙, 치과의사규칙으로 구성된 소위 ‘의료 3규칙 체제’는 의료인의 자격, 업무 범위와 직역별 역할 등에 관한 기본적 틀을 제공 했으며, 이후 한국 의료법의 근간이 되었다. 결론적으로 대한제국 및 일제강점기 초기의 의료 법제 변화는 한국 근대 의료 체계 형성의 중요한 전환점이 되었다. 이 시기의 법제는 단순한 의료 제도의 변화를 넘어 사회 적, 문화적, 정치적 변동을 반영하는 것이었다. 특히, 한의학과 서양의학의 관계 재정립, 의료인 자격 관리 체계의 확립 등은 현대 한국 의료 체계의 기초를 형성했다고 볼 수 있다.
