The purpose of this study was to analyze the problems of the Child Welfare Act and the Child Abuse Punishment Act as perceived by teachers who were reported for child abuse, and the ways to improve them. To do so, we used interview data from nine teachers in kindergartens, elementary schools, and secondary schools who had been reported for child abuse. The data collected were analyzed using the Inductive Thematic Analysis method. As a result of the study, the teachers pointed out the following problems with the Child Welfare Act and the Child Abuse Punishment Act: difficulty in distinguishing between discipline and emotional abuse, neutralization of student discipline, instrumentalization of complaints, prolonged and excessive procedures in child abuse investigations, excessively long statute of limitations, reporting child abuse based on suspicion alone, lack of punishment for innocent reports, and misuse of the mandatory child abuse reporting system. Recommendations for improvement included strengthening the components of the child abuse law, distinguishing between educational activities and child abuse in the law, strictly responding to innocent reports of child abuse, shortening the duration and procedures of child abuse investigations, and shortening the statute of limitations for child abuse. This study is significant in that it analyzes the difficulties faced by teachers in dealing with the Child Welfare Act and the Child Abuse Punishment Act, and provides suggestions for improving the handling of child abuse reports against teachers in the future.

본 연구는 아동학대 피신고 교원들이 인식한 아동학대 관련 법률(아동복지법, 아동학대범죄의 처 벌 등에 관한 특례법)의 문제점과 개선방향을 분석하는 것을 목적으로 하였다. 이를 위해 유·초·중등 교원 중 아동학대 피신고 경험자 9명의 면담자료를 활용하였다. 또한 수집된 자료는 귀납적 주제분 석(Inductive Thematic Analysis) 방법으로 분석하였다. 연구 결과, 무혐의 아동학대 피신고 교원들은 아동복지법 및 아동학대범죄의 처벌 등에 관한 특례법의 문제점으로 훈육과 정서학대 구분의 어려 움, 생활지도의 무력화, 아동학대 신고의 불만 표출 도구화, 아동학대 수사의 장기화와 과중한 절차, 지나치게 긴 공소시효, 의심만으로 가능한 아동학대 신고, 무고성 신고에 대한 처벌 조항 부재, 아동 학대 신고의무제도의 오남용을 지적하였다. 이에 대한 개선 방향으로는 아동학대 법률의 구성요건 강화, 법률에 교육활동과 아동학대를 구분하는 조치 필요, 무고성 아동학대 신고에 대한 엄정한 대 응, 아동학대 수사 기간 및 절차의 단축, 아동학대 공소시효 단축을 제시하였다. 본 연구는 교원들이 아동복지법 및 아동학대범죄의 처벌 등에 관한 특례법으로 인해 겪는 어려움을 분석하여 향후 교원 대상 아동학대 신고의 처리절차 개선에 관한 시사점을 제공하였다는 점에서 의미가 깊다.
