Korea boasts high access to medical care, attributed to its advanced medical infrastructure and the operation of a comprehensive social security system known as National Health Insurance. Surgeries performed in medical institutions often require a high degree of skill depending on the type, and are frequently conducted for cosmetic purposes in addition to therapeutic purposes. However, due to ongoing concerns about patient safety stemming from medical accidents that can occur during procedures such as surgery, the revised Medical Law was enacted as a result of social consensus and discussions on the necessity of installing and operating CCTVs in operating rooms. The revision of the Medical Law is expected to contribute to the prevention of medical accidents and the improvement of patient safety, but on the other hand, concerns about personal information management and leakage accidents such as medical image information have been raised from all walks of life. In consideration of these points, this paper explored managerial and technical measures for the protection and secure operation of personal information, including medical video data from operating room CCTVs, through a review of domestic laws and guidelines related to the mandatory installation and operation of CCTVs in operating rooms. Medical institutions performing surgeries must install and operate CCTVs that meet the standards required by law, strictly enforce access restrictions to protect personal information, and ensure the technical security of video data to prevent information leakage incidents. Additionally, it is necessary to enhance the clarity of relevant laws and guidelines to thoroughly prevent the leakage of personal information, including medical image information.

우리나라는 뛰어난 의료수준과 국민건강보험이라는 사회보장제도 운영으로 의료 접근 성이 매우 높은 편이다. 의료기관에서 이루어지는 수술은 종류에 따라 고도의 술기를 요구 하는 경우가 대부분이며, 치료 목적 외에도 미용 목적으로도 드물지 않게 시행되고 있다. 하지만 수술 등 의료행위에서 발생할 수 있는 의료사고로 환자 안전 문제에 대한 우려가 지속적으로 제기됨에 따라 수술실 내 CCTV 설치·운영 필요성에 대한 사회적 공감대 형성 과 논의의 결과로 개정 ｢의료법｣이 시행되게 되었다. 이번 ｢의료법｣개정으로 의료사고 예 방과 환자 안전 향상에 기여할 수 있을 것으로 기대되나, 다른 한편으로는 의료 영상정보 등 개인정보 관리 및 유출 사고에 관한 우려가 각계에서 제기되었다. 이러한 점을 감안하 여 본고는 수술실 내 CCTV 설치·운영 의무화 관련 국내 관련 법령 및 가이드라인 검토를 통해 수술실 내 CCTV 의료 영상정보 등 개인정보 보호와 안전한 운영을 위한 관리적·기술 적 방안을 모색하였다. 수술을 시행하는 의료기관은 법령에서 요구하는 기준을 충족하는 CCTV를 설치·운영하고 개인정보 보호를 위한 권한 및 공간에 대한 접근 제한을 철저히 시행하고, 나아가 영상 데이터에 대한 기술적 안전성을 확보해 영상정보 유출 사고에 대비 할 필요가 있다. 또한, 관련 법령 및 지침의 명확성을 강화하여 의료 영상정보 등 개인정보 유출을 철저히 대비할 필요가 있다.
