The purpose of this article is to select two international cases, primarily the COVID-19 pandemic and Russia's invasion of Ukraine, which are considered in connection with Japan's constitutional context. The former case can discuss the relationship between constitutionalism and democracy by examining the issue of national emergency. The latter case is a representative issue surrounding the Japanese Constitution, and by examining the transformation of pacifism, including Article 9 of the Constitution, it highlights the transition of Japanese pacifism to defensivism, political internationalism, and liberal pacifism. Although the two examples differ to some extent, it can shed light on Japan's notion of the past and the complementarity of Japanese cultural theory. And it can be seen that the Japanese Constitution is always challenged in any way, and at the same time, there is a path to see the phenomenon in the constitutional context. Finally, this article also discusses its implications for South Korea.

현황 문제를 의식하는 이 글은 예기치 않은 사건들, 주로 코로나19 팬데믹과 러시아의 우크라이나 침공이라는 국제적인 두 사례를 선정하고, 이에 일본의 헌법 적 맥락을 연관시켜 고찰하는 데 목적이 있다. 전자의 사례는 국가의 긴급사태 문제를 통해 살펴봄으로써 입헌주의와 민주주의의 관계성을 논할 수 있다. 후자의 사례는 일본국헌법을 둘러싼 대표적인 쟁점인데, 헌법 9조를 포함한 평화주의의 변용을 검토함으로써 일본적 평화주의가 방위주의, 국제협조주의, 그리고 자유주 의적 평화주의로 이행하고 있다는 점을 부각시킨다. 두 사례는 정도의 차이가 있 으나, 일본의 과거에 대한 관념이나 일본문화론의 보완성 등을 조명할 수 있다. 또한 일본국헌법은 어떤 측면에서도 항상 도전받고 있으며, 동시에 헌법적 맥락에 서 현상을 볼 수 있는 경로가 있다는 점을 확인할 수 있다. 마지막으로 이 글은 한국에 대한 함의에 관해서도 언급한다.
