In terms of drones of policy in our country, the drone industry promotion policy and the flight restriction legal system are at odds with each other. Hence, the management and system are needed in consideration of unique characteristics in drones. To safe and expand the application area of drone, it is urgent to prepare a more realistic legal and institutional foundation. This study was grasped the problems about the regulations of the Drone Laws focusing on the Drone Act and was suggested the improvement direction in the provisions of the Drone Laws based on this. The directions are as follows. First, there is a need to regulate the separate drone definition that reflected the expansion in detective, logistics and passenger transportation areas. Second, a legal basis must be specified pertinent to the new provisions on the expansion in drone registration subjects, to the extension in the applicable regulations for drone insurance, to a method of using drones bracing for disaster and calamity, and to the utilization of drones by public institutions such as police drones. Third, in order for drones to be used more safely and efficiently, the legislative supplementation should come first for the protection of personal information and privacy. Fourth, the new provisions for drone operation qualifications need to bring about the segmentation of the education and qualification in line with it through the classification based on the purpose and stage of the drone. In this way, the objective in this study was to arrange the foundation of drone utilization as well as the public security administration by presenting the use detective, logistics and passenger transportation areas of a drone and the vitalization of drone industry in the legal aspect and the direction for amendment in a drone-related law.

우리나라의 드론 정책은 드론 산업 육성정책과 운항 제한 법체계가 상호 대립하고 있으 며, 소형 드론은 실제 법규 적용 시 제한이 따르고 있다. 또한 드론 활용 분야가 다양해지 고, 급격히 성장하고 있지만 드론의 안전 및 활용 확대를 위한 법적, 제도적 대응이 부족한 상황이다. 따라서 드론의 특수성을 고려한 관리 및 제도가 필요하며, 드론 활용 영역 확대 를 위한 보다 현실성 있는 법･제도적 기반의 마련이 필요하다. 이 연구에서는 드론법을 중심으로 드론법 규정의 문제점을 파악하고, 이를 바탕으로 드론법 규정의 개선 방향을 제시하였다. 그 방향은 다음과 같다. 첫째, 탐정, 물류 및 여객 운송 영역의 확대를 반영한 별도의 드론 정의에 대한 규정이 필요하다. 둘째, 드론 등록 대상 확대에 관한 조항의 신설, 드론 보험의 근거 규정 확대, 재난 및 재해 대비 드론 활용방안, 경찰 드론 등 공공기관의 드론 활용에 대한 법적 근거가 명시되어야 한다. 셋째, 드론이 보다 안전하고 효율적으로 운용되기 위해서는 개인정보 및 사생활 보호를 위한 법제적 보완이 우선적으로 이루어져야 한다. 넷째, 드론 운영 자격에 대한 조항 신설을 통해 드론의 용도 및 단계별 구분을 통해 그에 맞는 교육 및 자격을 세분화해야 한다. 이와 같이 본 연구에서는 법률적 측면에서 탐정, 물류, 여객 운송 등의 드론 도입 및 드론 산업 활성화를 위한 드론 관련법 개정 방향을 제시함으로써 보안 행정 은 물론 드론의 안전 및 활용 영역 확대를 위한 정책적 기반을 마련하고자 하였다.
