In modern society, as the variety of activities of teenagers increases, the physical, mental, and social problems they experience are increasing. As a result, youth research is increasing in Korea, but depending on the applicable law, the age range for proxy consent in the consent form differs, causing confusion between researchers and ethics committees. Therefore, it is necessary to review existing regulations to protect these vulnerable minor research subjects, and when conducting research on adolescents in domestic research, an accurate investigation of the age range for which parental consent is required is necessary. In this study, we focused on human subjects and human material research applying bioethics act. In order to present various universal standards necessary for passing the review of youth research, we reviewed the ‘Child Welfare Act’, ‘Personal Information Protection Act’, and ‘Bioethics Act’, which are laws targeting youth, to confirm the legal regulations and consistency of research on youth. Through a review of research targeting adolescents, we investigated whether they and their parents consented to the research content. Through this, it establishes consistency in legal regulations and ethical aspects for youth research, providing directions to protect the interests and safety of research subjects participating in research activities.

현대 사회에서 청소년들의 다양한 활동이 늘어나면서 청소년들이 겪는 신체적, 정신적, 사회적 문제가 증가하 고 있다. 이로 인해 국내에서 청소년 연구가 증가하고 있지만, 적용되는 법률에 따라 동의서의 대리 동의 연령대가 달 라 연구자와 윤리위원회 간에 혼선을 초래하기도 한다. 따라서 이러한 취약한 미성년자 연구대상자를 보호하기 위한 기존 규정의 검토가 필요하며 국내 연구에서 청소년 대상의 연구를 진행할 경우 부모의 동의가 필요한 연령대에 대 한 정확한 조사가 필요하다. 본 연구에서는 생명 윤리법을 적용하는 연구 중 인간 대상 연구와 인체유래물 연구를 중 점적으로 다루었다. 청소년 연구의 심의 통과에 필요한 여러 보편적 기준을 제시하기 위하여 청소년을 대상으로 한 법률 ‘아동복지법’, ‘개인정보보호법’, ‘생명윤리법’을 검토하여 청소년 대상 연구의 법적 규제와 일관성을 확인하였 고 기존 청소년 대상 연구 검토를 통하여 연구내용에 따른 본인 및 부모의 동의 여부를 조사하였다. 이를 통해 청소 년 연구에 대한 법적 규제와 윤리적 측면에서의 일관성을 제시하며, 연구 활동에 참여하는 연구대상자들의 이익과 안 전을 보호하기 위한 방향을 제시하고자 하였다.
