This study aims to propose alternatives as a follow-up research based on the criticism of the unconstitutionality of Articles 11 and 23 of the ACT ON PREVENTION OF ACCIDENTS AT COASTAL SEA in previous studies. Overcoming the limitations of prior research, which pointed out the unconstitutionality of these provisions without providing concrete alternatives, this study re-evaluates the issues raised in previous studies and suggests specific amendments through an analysis of relevant regulations. The research results confirm once again the unconstitutionality of Articles 11 and 23, Section 1, and identify new issues such as the scope of entities subject to compliance obligations and the absence of a legal basis for effective enforcement. As a specific alternative, the study proposes to explicitly define punishable acts in the law and provides concrete measures. While this research is significant in addressing the limitations of previous studies, it still has shortcomings as it does not clearly specify the detailed criteria set forth in safety regulations.

이 연구는 연안사고 예방법 제11조 및 제23조의 위헌성을 지적한 선행연구에 근 거, 후속연구로서 그 대안을 제시하고자 함에 목적이 있다. 기존 선행연구에서 해당 규정에 대한 위헌성을 지적하면서 그 구체적 대안을 제시하지 못하였던 한계를 극복 하고 구체적 대안을 제시하고자 하였다. 연구목적 달성을 위해, 선행연구에서 제기된 문제들에 관해 다시 한 번 검토하고, 관련 규정들에 대한 분석을 통해 구체적 개정안을 제시하였다. 연구결과 주요쟁점으 로 법 제11조 및 제23조 제1호의 위헌성을 다시한번 확인하고, 해당 규정의 준수의무 를 부담하는 주체의 범위에 관한 문제, 실효적 단속을 위한 근거규정의 부재 문제 등 새로운 쟁점을 발굴하였다. 이에 대한 구체적 대안으로 처벌 대상 행위를 법률에 구체적으로 규정할 것과 그 구체적 방안을 제시하였다. 선행연구의 한계를 보완하는 후속연구로서 이 연구는 의 의가 있으나, 안전수칙에서 정하게 되어 있던 세부기준을 명확하게 제시하지는 못했 다는 점에서 이 연구는 여전히 한계를 가진다.
