In the contemporary world, data's importance is continually rising, with the capacity to maintain and utilize data becoming a critical component of competitiveness for both businesses and nations. In this context, the use of crawling is expected to become more common, and the need for legal discussions about crawling is also increasing. Addressing this necessity, the study conducts an analysis of legal research trends concerning crawling, and the criminal liability associated with crawl-based data collection, utilizing a comprehensive literature review. It also examines the legal issues, referencing specific laws that have the potential to regulate activities related to crawling. Legal issues related to crawling extend across both civil and criminal realms. This study provides a comprehensive overview of these issues, with a particular emphasis on the criminal liability arising from crawl-based data collection. Based on the results of this study, the main implications include the need to expand discussions on the criminal liability related to crawling and the need for fair utilization of crawling within the legal system.

현대 사회에서 데이터의 중요성은 점점 커지고 있고, 데이터 보유 및 활용 역량은 기업 및 국가 경쟁력의 핵심 요소로 자리 잡고 있다. 이러한 맥락에서 데이터 수집 기술 중 하나 인 크롤링의 사용은 더욱 보편화될 것으로 예상되며, 이에 따라 크롤링과 관련된 법적 논 의의 필요성 역시 증가하고 있다. 본 연구는 이러한 필요성을 바탕으로, 크롤링 관련 법학 연구 및 크롤링 기반 데이터 수집의 형사책임 관련 법학 연구의 동향을 문헌 고찰을 통해 분석하고, 크롤링 관련 사항을 규율할 수 있는 대표적인 법령을 기반으로 법적 쟁점을 분 석하였다. 크롤링 관련 법적 쟁점은 민·형사적으로 다양하기에 관련한 핵심적인 내용을 종합적으로 다루되, 크롤링 기반 데이터 수집의 형사책임에 관한 내용을 더욱 중점적으로 다루었다. 본 연구는 분석 결과를 바탕으로 크롤링의 형사책임에 관한 논의 확대 필요성, 법체계 내에서 크롤링의 공정한 활용의 필요성 등을 주요 시사점으로 제시하였다.
