In this paper, we compared the evolution of the inheritance systems in Vietnam and North Korea and attempted to understand the current status of North Korea's inheritance system. After the end of World War II, Vietnam and North Korea prioritized socialist values of joint production and joint distribution and took a negative stance on individuals' private property and inheritance. As the economy retreated and people's livelihoods became difficult, Vietnam and North Korea enacted family laws and inheritance laws, reorganizing the scope of personal ownership and inheritance-related systems. In Vietnam, inheritance was legally codified through the adoption of the Marriage and Family Act in 1959 and the Inheritance Act in 1990, and in North Korea, the Family Act in 1990 and the Inheritance Act in 2002 were adopted. North Korea adopted family law and inheritance law more than 10 years later than Vietnam, and land use rights are not included in the scope of inherited property. In contrast, Vietnam is achieving economic development by reorganizing the inheritance-related system, including specifying the categories and inheritance of land use rights in 1995 and revising it once in 2005.

본고에서는 베트남과 북한의 상속제도의 변천을 비교하고, 현재 북한의 상속제도 현황을 파악하고자 하였다. 제2차세계대전 종전 이후 베트남과 북한은 공동생산, 공동분배의 사회 주의적 가치를 우선하여 개인의 사적 재산과 상속에 부정적 입장을 취하였 다. 경제는 후퇴하고 민생은 어려워지는 속에 베트남과 북한에서는 가족법 과 상속법을 제정함으로써, 개인이 소유할 수 있는 범위와 상속과 관련한 제도를 정비하였다. 베트남에서는 1959년 혼인과가족법, 1990년 상속법 제정을, 북한에서 는 1990년 가족법, 2002년 상속법 채택으로 법적으로 상속을 명문화했다. 북한은 가족법 및 상속법 채택이 베트남보다 10년 이상 늦었고, 또 상속 재산의 범주 안에 토지이용권 등은 포함되지 않는다. 이에 비해 베트남은 1995년 토지이용권의 범주와 상속을 명문화하고, 2005년 한차례 개정하는 등 상속 관련 제도 정비를 통해 경제발전을 이뤄나가는 중이다.
