This study was raised by the need to revise the 'Police Drone Operation Rule', the basis for the operation of police drones enacted in 2019, and was conducted to seek revision measures. The research method reviewed previous domestic and foreign studies related to the use of drones by the police, compared and analyzed related laws such as the Marine Police Agency and the Fire Department's orders outside the police, the Police Aviation Operation Rules, and the Police Equipment Management Rules. The current Police Drone Operation Rules include narrow operation scope, ambiguous operation laws, lack of interpretation of search terms, lack of immunity in the event of an accident, lack of budget support for civilian search teams, lack of drone operator training and incentives, It suggested adding provisions for supporting technology development and securing public sympathy with field employees. Based on the results of the study, policy suggestions such as reorganization of the relevant legal system, expansion of drone departments and manpower, introduction and operation of various aircraft, and correct citation of overseas cases were made. This study is meaningful as a prescription study that analyzes the problems of the current order and presents specific and relevant amendments, and is valuable as policy data in revising the National Police Agency order. Through this study, it is hoped that it will not only help to improve the operating rules of police drone, but also serve as policy data for drones in more diverse and diverse fields, and various follow-up studies will continue in academia, including the National Police Agency.

이 연구는 2019년제정된경찰드론의 운용 근거규정인 ‘경찰무인비행장치운용규칙’ 의 개정 필요성에 의해 제기되었으며 개정방안을 모색하기 위해 수행되었다. 연구방법 은 경찰의 드론활용과 관련된 국내·외의 선행연구들을 검토하고 관련법령을 비교분석 하였다. 문제점으로 운용범위 협소, 운영 소관법률 모호, 수색 용어의 해석 혼용, 사고 발생 시 면책조항 부재, 민간인 수색단 예산지원 근거 미비, 항공안전법 특례조항 적용 혼선, 드론 운용자 전문교육 및 인센티브 부족 등을 제시하였고, 개선방안으로 경찰청 훈령의 운영범위 확대, 수권법률인 경찰관직무집행법 일부 개정, 경찰항공운영규칙과 경찰장비관리규칙의 내용반영 등관련 법령 체계를 갖출것을 제안하였으며, 세부적으 로 ‘수색’ 용어의 변경 또는 삭제, 면책 조항 및 보험 규정 추가, 민간 수색대 동원 및 예산지원 조항 신설, 타경찰청 경찰관 지원출동 조항 명시, 기술개발 지원 조항 추가, 현장 경찰관들과 국민 공감 확보 등을 제시하였다. 연구결과를 바탕으로 관련 법률 체 계의 정비, 드론부서의 확대와 인력 확충, 다양한 기체의 도입 및 운영, 해외사례의 올바른 인용 등의 정책적 제언을 하였다. 본 연구를 통해 경찰 무인비행장치 운용규칙의 현실적 개선에 도움이 됨은 물론, 경찰청에서 드론을 활용할 수 있는 정책자료가 되기 를 희망하면서, 경찰청을 비롯한 학계에서도 다양한 후속연구가 이어지기를 기대한다.
