The purpose of this article is to review policy alternatives to eradicate prostitution via cyberspace at a time when the central axis of prostitution has rapidly shifted to cyberspace, focusing on relatively recent legal changes and discussions surrounding them. To this end, ① laws and recent amendments related to the regulation of prostitution(Ⅱ), ② improvement measures to eradicate prostitution using cyberspace(Ⅲ), and ③ other matters requiring additional review(Ⅳ) are sequentially reviewed. It was reviewed. According to the results of this review, ① the creation of a dedicated organization to respond to acts of sexual exploitation of children, ② the reorganization of related regulations to reconsider the efficiency of undercover investigations (in particular, the punishment provisions for preliminary and attempted prostitution of children and adolescents) ), ③ systematic regulation of banner advertisements on illegal sites such as prostitution portal sites in cyberspace, ④ use of seizure and search of remote servers, etc., and ⑤ introduction of an online search system. However, it was also pointed out that there is a need to not only simply introduce new investigative means, but also establish a basis for crackdowns on so-called ‘sidewalk businesses’ and ‘massage parlors’ so that efficient crackdowns can be carried out offline. Lastly, we must overcome the controversy over whether prostitution is a crime and recognize the seriousness of prostitution as a type of act that violates the sexual self-determination rights of children and adolescents. As a starting point, it was emphasized that the perception must be changed from prostitution to sexual exploitation.

이 글은 최근 성매매의 중심축이 급격하게 사이버공간으로 이동한 시점에서 사이버공간을 경유하는 성매매를 근절하기 위한 정책적 대안을 비교적 최근의 법률적 변화와 이를 둘러싼 논의를 중심으로 검토함에 목적이 있다. 이를 위하여 ① 성매매의 규제와 관련성이 있는 법 률과 최근의 개정 현황(Ⅱ), ② 사이버공간을 이용한 성매매 근절을 위한 나름의 개선방안 (Ⅲ)과 ③ 기타 추가적으로 검토가 필요한 사항(Ⅳ) 등을 순차적으로 검토하였다. 이와 같은 검토의 결과에 따라 ① 아동대상 성착취 행위에 대응하기 위한 전담기구의 창 설, ② 위장수사의 효율성 재고를 위한 관련규정의 정비(특히 아동⋅청소년 대상 성매수 예 비 및 미수행위에 대한 처벌규정), ③ 사이버공간에서의 성매매 업소사이트 등 불법사이트 배너광고에 대한 체계적 규제, ④ 원격지 서버 등에 대한 압수⋅수색의 활용, ⑤ 온라인 수색 제도의 도입 등의 정책적 대안을 제안하였다. 다만 단순하게 새로운 수사수단을 도입하는 것 에 그칠 것이 아니라 오프라인에서도 효율적인 단속이 이루어 질 수 있도록 소위 ‘보도방영 업’과 ‘마사지업소’ 등에 대한 단속근거도 마련해야 할 필요가 있음을 함께 지적하였다. 마지 막으로 성매매가 범죄인지의 여부에 대한 논란을 극복하고 이제는 아동⋅청소년의 성적 자기 결정권을 침해하는 행위의 일종으로서 성매매의 심각성을 인식해야 할 것이며, 그 출발점으 로서 성매매에서 성착취로 인식을 전환해야 한다는 점을 강조하였다.
