The maritime safety supervisor system was promoted as part of preparing measures to strengthen safety management to reduce maritime accidents as an integrated maritime safety management system was prepared following the establishment of the Ministry of Oceans and Fisheries through the amendment of the Government Organization Act in 2013. At that time, the main focus of the introduction of this system was to establish an institutional foundation for converting the measures to respond to marine accidents previous follow-up guidance and inspection system to a proactive management system, which was introduced through the amendment of the Maritime Safety Act on May 14, 2014. On the other hand, the operation of maritime safety supervisors is clearly divided into specialized fields(operation supervisor and seaworthiness supervisor) and responsible duties(passenger ship supervisor, cargo ship supervisor, and deep-sea fishing vessel supervisor). In addition, such measures are intended to actively respond to various risk factors that hinder the safe operation of ships, which are reflected in the qualifications and recruitment process of maritime safety supervisors. In this way, the maritime safety supervisor system is strictly divided and operated based on the major and social experience of the maritime safety supervisor. However, in the field, there is an aspect of operating unreasonable according to circumstances without establishing a clear concept in performing its role such an operating method can eventually act as a factor that hinders the cohesion of an organization operated with a small number of personnel and the ability to respond on the spot, so it is necessary to prepare improvement measures for this. Accordingly, this study discusses the appropriateness of the relevant regulations that classify the current maritime safety supervisors through qualifications, subjects of supervision, scope of duties, recruitment requirements, and nationwide distribution of maritime safety supervisors and presents institutional improvement measures to operate more clearly according to the purpose of the introduction of the maritime safety supervisor system.

해사안전감독관 제도는 과거 2013년 ｢정부조직법｣개정으로 해양수산부 신설에 따른 통 합 해양안전관리 체제가 마련됨에 따라 해양사고의 감소를 위한 안전관리 강화 대책 마련 의 일환으로 추진되었다. 당시 이 제도에서 중점적으로 추진하고자 한 사항은 해양사고 대응에 따른 조치에 있어 종전 사후 지도․점검체계를 사전 예방적 관리체계 중심으로 전환 하기 위한 제도적 기반 마련에 두고 있으면서, 이는 2014년 5월 14일 ｢해사안전법｣ 개정을 통해 도입되었다. 한편, 해사안전감독관의 운용에 있어서는 전문 분야별(운항⋅감항감독 관)․담당 업무별(여객선⋅화물선⋅원양어선감독관)로 명확히 구분하고 있으며, 이와 같은 조치는 선박의 안전운항을 저해하는 다양한 위험 요소에 적극 대응하기 위한 것으로 관련 내용들은 해사안전감독관의 자격요건 및 채용과정에도 반영되어 있다. 이와 같이 해사안전감독관 제도는 해사안전감독관의 전공 및 사회경험 등을 기반으로 엄격히 구분해서 운영하도록 하고 있으나, 현장에서는 그 역할을 수행하는데 있어 명확한 개념 정립 없이 형편에 따라 불합리하게 운영되고 있는 측면이 있고 이러한 운영방식은 결국 조직의 결속력과 현장 대응능력을 저해하는 요인으로 작용할 수 있으므로 이에 대한 개선책 마련이 필요하다. 이에 따라 본 논문에서는 해사안전감독관의 자격, 감독대상, 직무 범위, 채용요건 및 전국 배치분포 등을 통해 현행 해사안전감독관을 구분하고 있는 관련 규정의 적정성 등에 대해 살펴보고, 또한 최초 해사안전감독관 제도를 도입하게 된 근본 취지에 따라 보다 명확하게 운영하기 위한 제도적 개선방안을 제시하고자 한다.
