Since the enforcement of the "Amendment to the Public Officials Accident Compensation Act" on June 11, 2023, the procedures for compensation for public officials' accidents have changed significantly. In the event of an official disaster, such as a police official, fire fighter, or post officer in a dangerous or special environment, the government, not an individual, is responsible for proving that there is no significant causal relationship between the official and the disaster, enabling quick and simple compensation. On the other hand, in the case of police officials, the official accident estimation system was limitedly applied to cerebrovascular diseases, heart diseases, and mental diseases according to the rules of the Ministry of Personnel Management. It is difficult to understand that these diseases were excluded from the presumption at a time when the relationship between the work of police officials and the occurrence of musculoskeletal diseases has been confirmed through domestic and foreign studies. In California, USA, a law presuming lower back disorders caused by duty belts worn by police officers has been proactively implemented. According to a study commissioned by the Korean National Police Agency in 2022 titled "Analysis and Support Measures for Health Risk Factors like Musculoskeletal Disorders in Police Officers." musculoskeletal disorders rank second only to depression as the most significant ailment among police officers. Survey results confirmed that they experience a rate of musculoskeletal disorders about 16 times higher than the general population, significantly impacting their daily life and social activities. This study proposes to recognize the presumption system for musculoskeletal diseases of police officials in consideration of the occupational specificity of police officials who usually work wearing heavy equipment such as patrol units, detectives, and task forces. It also proposes conducting cohort studies to prove the relationship between the job of police officials and musculoskeletal diseases and policing R&D to develop a comprehensive musculoskeletal health management platform.

2023년 6월 11일, ‘공무원 재해보상법 개정안’ 시행 이후, 공무원의 공무상 재해 보상에 관한 절차 가 크게 변화하였다. 위험하거나 특수한 환경에서 공무를 수행하는 경찰, 소방, 우체국 등 공무원이 공무상 재해를 입을 경우, 공무와 재해 사이에 상당한 인과관계가 없음을 입증할 책임을 개인이 아 닌 국가가 부담하도록 함으로써 공무상 재해를 입은 공무원에게 신속하고 간이한 절차를 통한 보상 이 가능해졌다. 이는 특수직 공무원의 적극적인 공무수행을 뒷받침 해줄 수 있다는 점에서 바람직하 다고 평가받고 있다. 그런데 경찰공무원의 경우 인사혁신처 예규에 의해 뇌혈관 질병, 심장 질병, 정 신질환에 대해서만 제한적으로 공무상 재해 추정제도를 적용받게 되었다. 경찰공무원 업무와 근골격 계 질환의 발생 사이의 연관성이 국내·외 연구를 통해 확인되고 있는 시점에서, 이들 질병이 법률이 아닌 예규에 의해 공상 추정 대상에서 제외된 것은 이해하기 어렵다. 미국 캘리포니아주에서는 외근 벨트로 인한 경찰관의 등허리(lower back) 질환에 대해 공상을 추 정하는 법안이 시행되고 있는 점은 주목할만하다. 2022년 경찰청에서 발주한 ‘경찰관 근골격계질환 등 건강 위험요인 분석 및 지원방안 연구’에 따르면, 근골격계질환은 우울증에 이어 두 번째로 경찰 관에게 중요하며 일반인과 비교했을 때 약 16배 정도 높은 비중으로 일상생활이나 사회활동에 많은 제한을 받고 있다는 설문조사 결과가 확인되었다. 본 연구는 순찰지구대, 형사, 기동대 등 평소 무거운 장구를 착용하고 근무하는 경찰공무원의 직 업적 특수성과 美캘리포니아·일본의 유사 법제도 등을 고려하여 경찰공무원의 근골격계질환에 대 해서도 공상 추정제도를 도입할 것을 제안한다. 또한 장기적으로는 경찰공무원의 직무와 근골격계질환의 연관관계를 증명하기 위한 코호트적 연구와 근골격계 건강 종합관리 플랫폼을 개발하기 위한 치안 R&D를 수행을 서둘러야 할 것이다.
