An Analysis on the Past and Present Challenges to the GATT⋅WTO Most-Favored Nation Principle under the World Order in Times of Turbulence
Most-Favored Nation (MFN) is one of the two core pillars of the non-discrimination principle, which is foremost significant philosophy of the GATT⋅WTO multilateral trade system. However, it has hardly been free from the criticism regarding its side effect like free-riding, and numerous exception clauses filled with ambiguity and generosity. Moreover, the MFN treatment is now often misused as a means to sanction or suppress competitors with the recent trend of de-globalization. The original intent of the principle must be reconfirmed while the WTO members are expected to continue seeking for timely amendment of the related rules.
