The Korea Coast Guard started as a Maritime Police Department under the Public Security Bureau of the Ministry of Home Affairs in December 1953 and has been responsible for ensuring maritime security, maintaining public safety and order, responding to maritime pollution, and protecting maritime fishery resources and maritime facilities, in the guarded waters under our police authority. As a national police agency, most of the public officials in charge of this are assigned police officers status, but among them, important tasks related to marine pollution responding are operated by dividing the members of the organization into police officers and general public officials. On the other hand, such an organizational operation system has long been raised as a social problem that not only causes confusion in the on-site command system in marine pollution accidents but also reduces the responsiveness of pollution control. In addition, compared to police officers status, which account for the majority of the members of the Korea Coast Guard, general public officials show relatively limited status and roles in performing their duties, which also hinders cohesion between members of the organization. In fact, the dualization of the command system for pollution response measures by the Korea Coast Guard is evaluated to have a negative impact on prompt initial action and efficient accident management of the large-scale oil pollution accidents that occurred in the Sea Prince(1995) and the Hebei Spirit(2007). Accordingly, in this study, the characteristics of the operation system and duties of the pollution responding organization through statistics on marine pollution accidents and the operation status of responding personnel, in addition, through comparison and review charge of pollution responding duties with the status system of similar organizations in other countries, the problem of dualizing the status of public officials in charge of pollution control at the Korea Coast Guard was analyzed. In this regard, the necessity and validity of integrating and operating the status of public officials in charge of pollution responding into police officers will be presented in detail in connection with legislative improvement.

해양경찰청은 1953년 12월 내무부 치안국 소속 해양경찰대를 시작으로 현재까지 우리나라 경찰권이 미치는 해역에서의 해양안전 확보, 치안질서 유지, 해양오염 방제, 해양수산자원 및 해양시설 보호 등의 업무를 수행하는 국가경찰 기관으로 이를 담당 하고 있는 대부분의 공무원은 경찰직 신분으로 두고 있으나, 이 중 해양오염 방제와 관련한 중요사무는 경찰직과 일반직으로 조직구성원을 이원화하여 운영하고 있다. 한편, 이 같은 조직운영 체계는 해양오염사고에 있어서의 현장 지휘체계에 혼선을 초래하는 것은 물론이고, 오염방제의 대응력을 저하시키는 사회적 문제로 오랜 기간 제기되어 왔다. 또한 해양경찰청 조직구성원의 대부분을 차지하고 있는 경찰직에 비 해 일반직은 상대적으로 업무 수행에 있어서의 신분적 제약 및 역할의 한계를 보이 고 있어 조직 내 구성원 상호 간 결속력을 저해하는 원인으로 작용하기도 한다. 실제 해양경찰청의 방제조치 지휘체계 이원화는 씨프린스호(1995년) 및 허베이 스피리트호(2007년)에서 발생한 대형 유류오염사고의 신속한 초동조치와 효율적인 사고수습에 있어 부정적 영향을 미친 것으로 평가되고 있다. 이에 따라 본 논문에서는 해양오염사고 통계, 방제인력 운영 현황 등을 통한 오염 방제조직 운영체계 및 직무의 특성, 그리고 다른 나라 유사기관에서 오염방제 직무 를 담당하고 있는 구성원과의 신분체계 비교·검토를 통해 해양경찰청 오염방제 담당 공무원의 신분 이원화에 따른 문제점에 대해 분석해보고, 이와 관련해서 오염방제 업무 담당 공무원의 신분을 경찰직으로 통합하여 운영하는 것에 대한 필요성 및 타 당성 등을 법제 정비 등과 연계해서 그 대응방안을 구체적으로 제시하고자 한다.
