The main purpose of this study is to examine the legal status of private marine rescue workers under the enactment of the tcivilian marine rescue team Act on the Establishment and Operation of Private Marine Rescue Team and legal responsibility for negligence issued in the rescue process. Currently, private maritime rescue teams recruited and operated by each maritime police station across the country are securing their status as an important rescue force in marine accidents. Marine accidents are rescued by mobilizing all possible forces, and the rescue ratio of fishing boats or private marine rescue teams accounts for about 20% of all marine accidents. As the importance of private maritime rescue teams increases, the Maritime Police Agency has prepared a bill to establish the "Act on the Establishment and Operation of Private Marine Rescue Teams" and is set to be enacted by the National Assembly. In this regard, this paper aims to derive problems and improvement measures for the legal status of private marine rescue workers and the legal responsibility caused by negligence during rescue activities when the Act on Private Marine Rescue Team is enacted. Through this, we would like to consider the scope and limitations of legal responsibility of private marine rescue workers and suggest support measures for legal litigation.

이 연구의 주요 목적은 ｢민간해양구조대의 설치 및 운영에 관한 법률｣ 제정(안) 에 따른 민간해양구조대원의 법적 지위와 구조과정에서 발행하는 과실로 인한 법적 책임에 대하여 살펴보고자 한다. 현재 전국의 각 해양경찰서에서 모집하여 운영하는 민간해양구조대는 해양사고의 중요한 구조 세력으로 지위를 확보해 나가고 있다. 해양사고는 동원 가능한 모든 세력을 동원하여 구조하고 있으며 어선이나 민간해 양구조대의 구조 비율은 전체 해양사고의 약 20%를 차지하고 있다. 해양경찰청에서 는 민간해양구조대의 중요성이 높아짐에 따라 체계적인 관리와 지원을 위한 법적 근 거를 마련하기 위해｢민간해양구조대의 설치 및 운영에 관한 법률｣안을 마련 국회 상정하여 제정을 앞두고 있다. 이와 관련하여, 본 논문에서는 민간해양구조대에 관한 법률이 제정되면 민간해양구조대원의 법적 지위와 구조 활동 중에 발생하는 과실로 인한 법적 책임에 대한 문제점과 개선방안을 도출하고자 한다. 이를 통해 민간해양 구조대원의 법적 지위와 책임의 범위와 한계에 대하여 고찰하고 법적 소송 대비 지 원 방안을 제시하고자 한다.
