Korea has problems such as a decrease in market share in national core technology-related industries, a narrowing of the science and technology gap with “technological catching-up players,” and an increase in the number of overseas outflows of national core technologies. Therefore, the need for measures to prevent leakage of national core technology is being emphasized. Korea has traditionally complied with the obligations of the TRIPs agreement and filed many patent applications. In addition, it entered the advanced country group by pursuing global market preoccupation and industrial development. Now, from an industrial security perspective, it is necessary to revise the Patent Act to protect national core technology. This paper confirmed the risk of leakage of national core technologies and reviewed the possibility of indirect technology leakage by laying-open of applications. In addition, the Act on prevention of divulgence and protection of industrial technology and the Patent Act were compared. It also compared international application regulations in other countries. The limitations and problems of the Patent Act were identified. After the amendment to the Patent Act to protect national core technologies was reviewed. it proposed an amendment to the secret patent system that could protect national core technologies without violating the obligations of the TRIPs agreement. The amendment will be able to prevent technology leakage of national core technologies in advance and it will be a reasonable measure considering the balance between technological security and industrial development.

최근 지정된 국가핵심기술 분야의 시장점유율 감소, 기술 추격국과의 중점 과학 기술격차 축 소, 국가핵심기술의 해외 유출 건수 증가 등의 문제들로 인해 국가핵심기술의 유출 방지를 위한 제도적 방안의 필요성이 강조되고 있다. 한국은 전통적으로 TRIPs 협정 의무 준수와 특허 다출 원을 통한 글로벌시장 선점 및 산업발전을 추구하며 선진국 그룹으로 진입하였으며, 이제는 산 업보안 관점에서 국가핵심기술 보호를 위한 특허 관련 법·제도의 검토 및 개선이 필요하다. 본 논문은 최근 시장점유율과 기술 최약국과의 기술격차 동향을 조사하여 국가핵심기술유출의 위 험성과 공개된 특허 문헌에 의한 간접적인 기술유출의 가능성을 검토하였다. 이어서 산업기술보 호법과 특허법 비교 및 PCT 체약국들의 국제출원 규제사항을 비교하고 국가핵심기술 보호의 관 점에서 현행 특허제도의 한계와 문제점을 확인하였다. 그리고 국가핵심기술을 보호하기 위한 특 허제도의 개정안을 검토한 TRIPs 협정 의무를 위반하지 않으면서 국가핵심기술의 보호가 가능 한 비밀특허제도 개정안을 제안하였다. 해당 개정안은 국가핵심기술의 직접적인 기술유출을 초 래할 수 있는 간접적인 기술유출을 사전에 방지할 수 있을 것이며, 기술안보와 산업발전의 균형 을 고려한 합리적 방안이 될 것으로 기대된다.
