Recently, the introduction of human rights ordinances (HROs) has been spreading in South Korea's local governments. However, there is a conspicuously harsh religious backlash from the Protestant communities against the adoption of the ordinance. Accordingly, local governments have been dropping on the proposal and hesitate to adopt HROs. Why did some local governments introduce HROs, while others did not? To answer this question, we analyze what factors affect the passage of HROs by lower-level governments from 2010 to 2019. Based on our discrete event history analysis, results show that civil society factors positively influenced the adoption of HROs, while religious factors negatively affected the adoption of HROs. In particular, the higher the number of Protestant organizations among the lower-level governments that proposed the ordinance, the less likely it was passed. In addition, through the minutes of meetings of local governments, we found that Protestant groups were concerned about the issue of sexual minorities and the spread of anti-discrimination laws, so they want to thwart the adoption of human rights ordinances. The results of our study are meaningful because we found that civil society and religious factors have an important influence in the process of adopting human rights ordinances by local governments.

최근 10년 동안 한국의 지방자치단체에서 인권조례가 도입 및 확산되고 있다. 하지 만, 인권 조례의 채택에 대한 개신교 집단의 종교적 반발이 거센 상황이다. 이에 따 라 지방자치단체들은 인권조례 발의를 포기하거나 인권조례 채택을 주저하고 있다. 왜 어떤 지방자치단체는 인권조례를 도입했지만 어떤 지방자치단체는 도입하지 않았 을까? 이 질문에 답하기 위해 이 연구는 2010년부터 2019년까지 한국 지방자치단체 의 인권조례 통과에 영향을 미치는 요인이 무엇인지 경험적으로 분석한다. 우리의 사 건사 분석 결과는 시민 사회 요인이 인권조례 채택에 긍정적인 영향을 미친 반면 종 교적 요인은 인권조례 채택에 부정적인 영향을 미쳤다는 점을 보여준다. 특히 인권조 례를 발의한 지방자치단체 중 개신교 단체 수가 많은 지자체에서 인권조례가 통과될 가능성이 적게 나타났다. 또한, 지방자치단체 회의록을 통해 개신교 집단이 성소수자 문제와 차별금지법 확산을 걱정하여 인권조례를 무산시키려 한다는 점도 드러났다. 우리의 연구 결과는 시민사회와 종교적 요인이 지방정부의 인권조례 도입과정에서 중요한 영향을 미친다는 점을 발견했다는 점에서 의의가 있다.
