This study focuses on the contents of the 'prohibited' decision in the 「Resolution on the use of artificial intelligence by the police and judiciary in criminal cases」 of the European Parliament on October 6, 2021, for smart policing policies in the field of domestic criminal justice. We looked at factors that could have an impact. Domestic smart policing policies follow the trend of the United States and the United Kingdom. As a result of the study, the problem of 'bias' still existed at the center of the change in policy direction caused by 'ban'. This study is meaningful in that it is a study that presents the direction of the current smart policing policy and the decision to 'ban' based on the humanities point of view. In addition, the need for interdisciplinary attention was emphasized in the discussion of countermeasures for improvement in terms of being a latecomer to smart security policies, unlike advanced countries in artificial intelligence systems.

이 연구는 2021년 10월 6일 유럽의회(European Paliament)의 ｢형사사건에 대한 경찰･사법부의 인공 지능 사용 결의안｣에서 ‘금지’한 결정의 내용을 중심으로 국내 형사사법 분야의 스마트 치안 정책에 영향을 미칠 수 있는 요인을 살펴보았다. 국내 스마트 치안 정책은 미국, 영국 등의 흐름을 따르고 있다. 연구 결과, ‘금지’로 인해 발생하는 정책 방향성의 변화 중심에는 여전히 ‘편향성’이라는 문제가 존재하였 다. 본 연구는 인문학적 관점을 토대로 ‘금지’ 결정과 현 스마트 치안 정책의 방향성을 제시한 연구라는 점에서 의의가 있다. 아울러, 인공지능 시스템의 선진국과는 달리 스마트 치안 정책의 후발 국가라는 측면에서 개선 대응 방안 논의에 학제적 관심의 필요성이 강조되었다.
