The purpose of this study is, first, to analyze whether the law of war is being properly observed in the recent war between Ukraine and Russia; . As a result of the study, Ukraine generally complies with the laws of war and receives support and support from the international community, but Russia is criticized and economic sanctions for failing to do so. The fundamental reason why the laws of war are not observed is that they put their own interests first, think that winning unconditionally will solve all problems, and that the war pattern is changing significantly along with the leader's political position. Therefore, in order to increase the effectiveness of the law of war, it is necessary to prevent war by supplementing the existing law of war and improving international organizations, and to minimize conflict by actively intervening if it has already occurred. I believe that this study can serve as an opportunity to establish legal responsibility and morality by analyzing war crimes such as civilian massacres in the war between Ukraine and Russia at the level of international law. We also strengthen our efforts to abide by the laws of war, participate in and support the universal value standards of the international community, such as freedom, peace and human rights, and maximize national interests by strengthening our capabilities in international law in preparation for future lawfare between countries. suggest to do

본 연구의 목적은 첫째, 최근의 우크라이나와 러시아 간의 전쟁에서 전쟁법이 제대로 준수되고 있는지를 분석하며, 둘째, 전쟁법이 준수되지 않는다면 그 원인은 무엇이고 그것의 실효성을 높이 는 방안을 제시하는 데 있다. 연구결과 우크라이나는 대체로 전쟁법을 준수하여 국제사회로부터 지지와 지원을 받고 있지만, 러시아는 그렇지 못하여 비난과 경제제재를 받고 있다. 전쟁법이 준 수되지 않는 근본 이유는 자국의 이익을 우선하고, 무조건 승리하면 모든 문제가 해결된다고 생각 하며, 지도자의 정치적 입지와 더불어 전쟁 양상이 크게 변화하고 있기 때문이다. 따라서 전쟁법 의 실효성을 높이기 위해서는 기존의 전쟁법을 보완하고 국제기구를 개선함으로써 전쟁을 예방하 고, 이미 발발했다면 적극적으로 개입하여 갈등을 최소화할 필요가 있다. 본 연구는 우크라이나와 러시아 간의 전쟁에서 벌어지는 민간인 학살 등 전쟁범죄를 국제법 차원에서 분석하여 법적 책임 과 도덕성을 확립하는 계기가 될 수 있다고 생각한다. 우리도 전쟁법을 준수하는 노력을 강화하 고, 자유와 평화, 인권 등 국제사회의 보편적 가치 기준에 동참하고 지원하며, 향후 국가 간 법률 전(lawfare)에 대비하여 국제법에 대한 역량을 강화하여 국익을 극대화할 것을 제안한다.
