The government has recently established and activated the "Serious Accidents Punishment Act" as part of measures to prevent such serious accidents, considering that large-scale human life accidents(death and injury) occured in various industries have been issued as a major social problem. Meanwhile, the government believes that the root cause of these accidents is mainly due to the lack of organizational culture or safety management system of firms. The Serious Accidents Punishiment Act is one of the preventative measures against continuous occurrences of industrial human accidents, but it is difficult to enforce such legal regulatory measures in the domestic fisheries with relatively poor working conditions and small-scale businesses compared to other industries. Moreover, the government has not sufficiently provided guidelines for minimizing social confusion in the application of the “Serious Accident Punishment Act” in the fishing sector and for implementing this law more efficiently. Accordingly, this study will examine current status of fishing vessel accidents and life damages, and various types of fishery disasters that may be subject to the "Serious Accident Punishment Act". Furthermore, surveying and analyzing commercial fishers' awareness of risk factors that may occur in major fishing processes intends to provide basic data necessary to prepare measures to stabilize the fisheries management system through the prevention and management of serious disasters. Also, this ultimately aims to prepare countermeasures to prevent serious disasters in the fishery sector in advance.

최근 정부에서는 여러 산업분야에서 재해로 인해 발생한 대형 인명사고(사망·부상)가 사회적 문제로 대두되는 것과 관련해서 이에 대한 근본원인을 기업의 조직문 화 또는 안전관리 시스템 부재에 따른 것으로 보고, 이와 같은 중대재해 사고를 사 전에 방지하기 위한 조치의 일환으로 현재 ｢중대재해 처벌 등에 관한 법률｣(이하 “중대재해처벌법”이라 한다)을 제정하여 운영하고 있다. 이 법은 중대한 산업재해가 지속적으로 발생하는 것에 대한 예방차원의 조치이나, 타 산업에 비해 상대적으로 열악한 작업환경과 영세한 경영규모를 가지고 있는 어업분야 사업체의 경우 이와 같 은 법률적 규제 조치 사항을 원활히 적용하기에는 현실적 어려움이 있다. 더욱이 정부에서도 어업분야의 ｢중대재해처벌법｣ 적용에 있어 사회적 혼란을 최 소화하고, 이 법을 보다 효율적으로 적용·시행하기 위한 지침이나 가이드라인을 어업 현장에 충분히 제공하고 있지 못한 실정이다. 이에 따라, 본 논문에서는 어선사고·인 명피해 현황 및 어선에서 발생할 수 있는 재해로 인해 ｢중대재해처벌법｣의 적용대상 이 될 수 있는 다양한 어업 재해 유형에 대해 살펴보는 것에 더해서 주요 어업분야 에서 발생할 수 있는 위험요인에 대한 어업인의 인식을 조사·분석하여, 중대재해 예방·관리를 통한 어업경영체계 안정화 방안을 마련하는데 있어 필요한 기초자료를 제 공하고자 한다. 또한 이는 궁극적으로는 어업분야의 중대재해를 사전에 예방할 수 있는 대응방안 마련에 그 목적을 두고 있다.
