The study evaluated the operation of the child ombudsperson system as well as the revision of the German Child and Youth Support Act and the establishment of a legal system for legal support for children and ombudsperson in Germany. Germany strengthened children’s rights to participation, information, advice, and counseling on June 10, 2021, with the establishment of the child ombudsperson, an independent spokesperson for children. The issue of the child ombudsperson system is to have legal authority, and the amended Child and Youth Support Act guarantees independence in terms of organization and function. First, the organization’s independence is not compromised by directives from the federal state cabinet or the Youth Administration. The independence of the children’s ombudsperson is protected in both full-time and honorary positions. Second, functional independence is ensured. It ensures the children’s ombudsperson’s expertise, autonomy, and decision-making power. Article 9a of the Child and Youth Support Act stipulates the child ombudsperson and office system, which includes children, adolescents, and families, and represents the child’s position when conflicts arise with public services, particularly the Youth Agency, as well as the authority and role of independent functions such as counseling and conflict resolution. The reform of the German Child and Youth Support Act, as well as the establishment of a legal system for legal support for children and ombudsperson in Germany, were evaluated in this study, as was the operation of the child ombudsperson system. Based on the findings of this research, we seek to draw implications for Korea, which is in the early stages of developing a child ombudsperson system.

본 연구는 독일의 아동옴부즈퍼슨 법적 지원에 관하여 독일의 아동⋅청소년지원법의 개정과 법 적 체계 구축을 분석하고, 아동옴부즈퍼슨 제도운영에 대해서 살펴보았다. 독일은 2021년 6월 10일 아동⋅청소년지원법 개정을 통해 아동을 위한 독립적인 대변기구인 아동옴부즈퍼슨 제도운영과 더 불어 아동의 참여, 정보, 자문 및 상담에 대한 아동의 권리를 강화하였다. 아동옴부즈퍼슨 제도의 쟁점은 법적 지위를 통해 독립적인 권한을 가지는 것인데, 개정된 아동⋅청소년지원법은 조직과 기 능적인 측면에서 독립성을 보장하고 있다. 첫째, 조직의 독립성이다. 외부적으로 연방 주 내각, 청소 년청 등의 지시나 영향을 받지 않는다. 아동옴부즈퍼슨은 정규직이나 명예직 모두 독립성을 보장받 는다. 둘째, 기능적인 독립성을 보장받는다. 아동옴부즈퍼슨의 전문지식과 자율성 그리고 의사결정 권을 보장한다. 아동⋅청소년지원법 제 9a조는 아동옴부즈퍼슨과 사무소에 관한 규정되어 있는데, 아동과 청소년 그리고 가족을 포함하여 아동⋅청소년 복지체계, 특히, 청소년청의 공공서비스와 갈 등이 발생할 때 아동의 입장을 대변함과 동시에 상담 및 갈등 조정 등의 독립적인 기능을 담당하는 권한과 역할을 제도적으로 규정하였다. 본 연구는 독일의 아동옴부즈퍼슨 법적 지원에 관하여 독일 의 아동⋅청소년지원법의 개정과 법적 체계 구축을 분석하고, 아동옴부즈퍼슨 제도 운영에 대해서 살펴보았다. 이러한 연구 결과를 토대로 아동옴부즈퍼슨 제도의 초기 단계인 우리나라에 적용 가능 한 시사점을 도출하였다.
