Going through the ideological conflicts, the Korean War, and the division of the Korean peninsula after 1945 liberation, the guilt by association system, which had existed in Korean society since pre-modern period, exerted a stronger influence and expanded its area. Unlike previous studies focusing on revealing the pain of victims and identifying the mechanism in relation to the guilt by association system in modern period, this paper focuses on the active attitude and subjectivity of the victims against the guilt by association system. The three oral statements cited in this paper and the mentioned victims reveal their subjectivity by using the crack to break through the surveillance of national violence, while suffering under the powerful structure of the guilt by association system. The guilt by association system played a role in blocking the subjects from entering the public posts such as soldiers or civil servants in the process of operating and operating at the actual life, but this was not achieved perfectly. The victims who appear in oral statements were not frustrated by the restrictions and disadvantages caused by the guilt by association system, but tried to overcome it by utilizing personal relationships. And by entering public office restrictively, they exposed the crack of the guilt by association system.

근대 이전부터 한국 사회에 존재해 왔던 연좌제는 해방 후 좌우 대립과 전쟁, 그리 고 분단 체제의 고착화가 진행되면서 더욱 강력한 힘을 행사하였으며, 그 영역 또한 확장되었다. 현대 한국 연좌제와 관련하여 피해자들의 피해 사실을 드러내고 그 메커 니즘을 규명하는 데 초점을 맞춘 기존 연구와 달리, 본고는 피해자들이 연좌제 맞서 보여준 능동적인 태도와 주체성에 주목하고자 한다. 본고에 인용된 세 건의 구술과 여기에 등장하는 인물들은 연좌제라는 강력한 구조 속에서 고통당하면서도, 그 균열 지점을 이용해 국가폭력의 감시망을 돌파하는 주체의 모습을 드러낸다. 연좌제는 그 실제 운영과 작동 과정에서 대상자들이 군인 혹은 공무원 같은 공적 영역으로의 진출하는 것을 차단하는 역할을 수행하였다. 하지만 이는 완벽하게 이루 어지지 않았다. 구술에 등장한 피해자들은 연좌제로 인한 제약과 불이익을 계속 받았 지만, 이에 좌절하지 않고 사적 친분 관계를 활용하여 이를 극복하고자 했다. 그리고 제한적으로나마 공직에 진출함으로써 연좌제의 균열 지점을 드러냈다.
