This study analyzes the types of breakage accidents of fishing gear that occur at sea, confirms the available methods and limitations that can be used, and derive improvement plans for the limitations of investigations using the analysis results. The causes of breakage of fishing gear during ship operation are diverse, and unlike land accidents, it is difficult to define a vessel because accidents that occur on the sea are clearly caused by CCTV or the absence of witnesses. The investigation proceeds by inferring the offender vessel by combining the fragmentary information of the perpetrator vessel obtained by analyzing the broken type of evidence and the vessel location information stored in the stored records of the VTS and the Coast Guard V-Pass system. Due to the absence of information, unclear time of accident, and loss of evidence over time, it was possible to confirm the limitations of the fishing gear damage accident investigation. As improvement measures that can reduce these accidents, first, reinforcement of the regular power regulation for ship location transmitters, second, improvement of fishing gear display, and third, tougher punishment for illegal movement and expansion of the fishing grounds were suggested as alternatives. It is hoped that the results of this study will recognize the need for research related to fishing gear damage incidents, and that the suggested improvement measures will be reflected in policies to reduce fishing gear damage accidents.

본 연구는 해상에서 발생하는 어구의 파단사고의 형태를 분석하여 활용할 수 있 는 방안과 한계를 확인하며 분석 결과를 활용한 수사의 한계에 대해 개선방안을 도 출하고자 한다. 선박 운항 중 발생한 어구 파단사고의 원인은 다양하며 해상에서 발생하는 사고 는 육상과 달리 CCTV나 목격자의 부재 등의 이유로 명확하게 가해 선박을 규정짓 기 어렵다. 사고 현장 증거물의 파단형태를 분석하여 얻은 가해 선박의 단편적인 정 보와 해상교통관제(VTS)와 해양경찰 V-Pass 시스템의 저장기록에 저장된 선박 위 치 정보를 조합하여 가해 선박을 유추하여 수사를 진행하지만, 선박 정보의 부재나 사고 발생 시각 불명확, 시간 흐름에 따른 증거물의 유실 등의 이유로 어구 손상사 고 수사의 한계점을 확인할 수 있었다. 이러한 사고를 줄일 수 있는 개선방안으로 첫째, 선박 위치 발신 장치 상시 전원 규정 강화, 둘째, 어구 표시 개선, 셋째, 구획 어장의 불법 이동 및 확장에 대한 처벌강화를 대안으로 제시하였다. 본 연구 결과가 어구 손상사건과 관련한 연구의 필요성을 인식하고, 제시한 개선 방안이 정책에 반영되어 선박과 어구의 충돌로 발생하는 어구 손상사고를 줄일 수 있기를 기대한다.
