Along with the increase in new crimes, the police work is also increasing, and if the conscripted police are abolished, there will be a situation in which large-scale crowd control and risk prevention activities due to congestion, which can be sudden and fragmentary, are simultaneously performed during regular law enforcement duties. Accordingly, some functional agency by private persons in the private sector, which can bring supplementary and alternative effects to police manpower, is required. In this regard, as a representative case, consignment to a security company under the 「Security Business Act」can be considered, and it is necessary to seek its effectiveness as an alternative to acting as an agent for police action by a private person who has the character of a police assistant through voluntary participation of citizens. Therefore, in this study, we look at the legal and theoretical basis for risk prevention activities as private individuals in public places, and based on this, we will discuss the introduction of systems necessary to secure the effectiveness of police action by private individuals and implications.

신종 범죄의 증가와 더불어 경찰 업무 또한 증가되고 있으며, 의무경찰 이 폐지 될 경우 상시적인 법집행 업무 수행 중 돌발적이면서 단편적일 수 있는 대규모 군중 통제와 혼잡 등으로 인한 위험방지활동을 동시에 수행하 는 상황이 발생할 수 있다. 이에 따라 경찰 인력의 보충적·대체적 효과를 가져 올 수 있는 민간영역에서의 사인(私人)에 의한 일부 기능적 대행이 요구된다. 이와 관련하여 대표적으로 「경비업법」상 경비업자에 대한 위 탁을 고려할 수 있으며, 시민들의 자발적 참여를 통해 경찰보조인으로서의 성격을 가진 사인의 경찰작용 대행 또한 하나의 대안으로 그 실효성을 모 색할 필요가 있다. 따라서 본 연구에서는 공공장소에서 사인 신분으로 위험 방지 활동을 할 수 있는 법적·이론적 근거를 살펴보며, 이를 토대로 사인에 의한 경찰작용 대행의 실효성을 확보하기 위해 필요한 제도 도입과 시사점 을 논의하고자 한다.
