Fishing has long been a key industry that provided healthy food for the Korean people, and it is understood that despite the sweat and hard work of fishermen, their interest in safety and efforts were neglected. In this study, the current status of fishing accidents was identified, related problems were analyzed, and tasks to be improved in terms of law and institution were presented. The fishing accident rate is very high and serious compared to other industries. The reasons for this are that the legal basis for fishing accident prevention activities is weak, the structural vulnerability of fishing, low awareness of fishing accidents, and the absence of a government dedicated to preventive activities are combined. In order to solve these problems, first of all, it is necessary to prepare a legal basis that comprehensively stipulates matters necessary for the prevention of fishing accidents. Next, the legal obligations of the government and fishermen to prevent safety accidents should be stipulated, and a dedicated institution should be designated to provide sufficient manpower and budget to the institution. In addition, public-private governance must be established. Through these efforts, the fishing accident rate should be reduced and the fishing sector should continue to develop safely in the future.

어업은 오랫동안 우리 국민들에게 건강한 먹거리를 제공한 핵심 산업이었고, 그 배경에는 어업인들의 땀과 노고가 있었음에도 정작 그들의 안전에 대한 관심과 노력 은 소홀했던 것으로 파악된다. 이 연구에서는 어업재해 실태를 파악하고 관련 문제 점들을 분석하여 법·제도적 측면에서 개선되어야 할 과제들을 제시하였다. 어업재해율은 타산업 대비 매우 높은 심각한 수준으로 나타나고 있다. 그 원인에 는 어업재해 예방활동의 법적 기반이 취약하고, 어업이 갖는 구조적 취약성과 어업 재해에 대한 낮은 인식도, 정부의 적극적인 예방정책 미흡과 전담조직 부재 등이 복 합적으로 작용하고 있는 것으로 파악된다. 이러한 문제점들을 해소하기 위해서는 어업재해 예방에 필요한 사항을 포괄적으 로 규정할 법적 기반의 마련, 안전재해 예방을 위한 정부와 어업인의 법적 의무의 규정, 실태조사·통계 관리, 안전기술 연구, 교육 등을 담당할 전담기관의 지정, 민·관 거버넌스의 구축 등이 필요하다. 이를 통해 어업재해율을 저감하고 어업분야가 향후 에도 안전하게 지속적인 발전을 이루어 나아가도록 해야 할 것이다.
