In accordance with the policy to encourage overseas expansion, the scale of overseas investment by Chinese companies is continuously increasing. some domestic enterprises and local multinational companies have been actively or passively involved in cross-border insolvency cases, Correspondingly, many domestic enterprises and local multinational companies have been actively or passively involved in cross-border insolvency cases, However, a comprehensive cross-border insolvency legal system has yet not be established in China, so a cross-border insolvency system is imminent. In view of this, this paper chooses the core issue of the cross-border insolvency system-the recognition and assistance of cross-border insolvency procedures as the research focus, and analyzes the necessity of the recognition and assistance system of cross-border insolvency procedures. And on the basis of exploring the basis for recognition and assistance in cross-border insolvency procedures, analyze the conditions of recognition and the ways of assistance and relief one by one, at last, this paper, combined with the current situation of China, put forward some suggestions on building a recognition and assistance system for cross-border insolvency procedures with Chinese characteristics and in line with the national conditions of China.

최근 몇 년간 중국정부의 해외진출장려정책에 따라 중국기업의 해외 투자 규모는 지속적으로 증가하고 있다. 기업의 글로벌화에 따라 중국 기업이 다른 나라에 파산판결이나 파산절차의 승인 및 지원을 신청하는 사건도 많아지고 있지만 반대로 외국기업이 중국에 파산절차의 승인 및 지원을 신청하는 사건도 점차 증가하고 있다. 그런데 중국은 아직 체계적인 과경파산절차의 승인 및 지원제도가 정 비되지 않아 실무상 각 법원은 법률적용상의 어려움을 겪고 있다. 또한 외국기업 파산절차의 승인 및 지원 신청에 대해 기존에는 속지 주의입장을 고수해 오다가 2007년 이후 수정된 보편주의입장으로 바뀌 면서 심사기준을 많이 완화했다. 그렇지만 아직도 호혜원칙, 중국내 채 권자이익보호, 공공질서의 유보 등과 같은 엄격한 심사기준을 두고 있 어 학계와 실무계에서 모델법 및 기타 완화제도를 도입해야 한다는 의 견이 제기되고 있다. 이에 본고는 과경파산절차의 승인과 지원제도를 중심으로 중국의 최 근 연구동향을 살펴본다.
