This thesis focuses on grasping the work-related disputes actually faced by the older workers and suggesting ways of improving the legal system. In order to more empirically study the reality of work-related disputes experienced by the older workers, 1,300 people aged 60 or older across the country were randomly selected and surveyed, and the results were analyzed. Based on the results of the analysis, the factors that cause work-related disputes faced by the older workers are reviewed. In order to solve the difficulties the older workers experience in the workplace, improvement plans of legal system are proposed for the expansion of full-time employment for the older workers, the prevention and settlement of conflicts and disputes between the older workers and employers, and the improvement of the working conditions for the older workers.

본 논문은 고령자의 근로 관련 분쟁 실태를 파악하고 이에 따른 법제도 개선방안을 제시하는 것을 연구 목적으로 한다. 실제로 근로를 하는 고령자들이 현장에서 겪고 있는 근로 관련 분쟁의 현실을 실증적으로 연구하기 위하여 전국의 60세 이상 고령자 중 1,300명을 무작위로 추출하여 설문조사를 실시하고, 그 결과를 분석하였다. 그 분석 결과를 바탕으로 고령자 근로 관련 분쟁의 원인이 되는 요소들을 검토하고, 고령자가 근로에 있어서 겪게 되는 어려움을 해소하기 위하여 고령자의 정규직 취업 확대, 고령 근로자와 사업주 간 갈등·분쟁의 예방·해결, 고령자 근로 여건의 개선 등에 관한 법적·제도적 개선방안을 제시하였다.
