This study classified blockchain-based digital assets, which are recognized as key technologies in the future industries, and examined the economic and legal aspects of each digital asset. Research on digital assets and blockchain can be said to be in the early stages compared to the future development prospects, and related economic theory and empirical analysis should continue. In addition, legal studies need to be preceded for future applications in industries and public sectors such as finance, medical care, and culture, as well as the continuation of optimal blockchain network design and stable settlement of blockchain technology in the field. The composition of this study is as follows. Section 2 examines the basic concepts of digital assets and blockchain, the types of digital assets, and market conditions. Section 3 examines the economic meaning of digital assets in terms of monetary functions, the possibility of providing innovative finance, and the discussion on the introduction of CBDC. Section 4 will look at the regulatory trends of each country and the regulatory direction for each digital company currently being discussed. Section 5 introduces the main contents and issues of the virtual asset bill and the digital asset bill currently proposed to the Congress, and the last section 6 concludes the paper by making suggestions on future research and policies.

본 연구는 앞으로의 산업 분야에서 핵심 기술로 인정받고 있는 블록체인 기반의 디지털자산을 분류하고 각 디지털자산의 경제학 측면과 법적 측면에 대해 살펴보았다. 디지털자산 및 블록체인의 연구는 앞으로의 발전 전망에 비하면 현재 초기 단계라 할 수 있고 관련 경제학 이론 및 실증분석은 계속 진행되어야 한다. 또한 향후 금융, 의료, 문화 등의 산업 및 공공 방면에서의 활용방안과 이를 위한 최적 블록체인 네트워크 설계의 지속과 현장에서의 블록체인 기술의 안정적 정착을 위하여 무엇보다도 법적 측면의 연구가 선행될 필요가 있다. 본 연구의 구성은 다음과 같다. 제2절에서는 디지털자산과 블록체인에 대한 기본 개념과 디지털자산의 종류 및 시장 상황에 대해 살펴본다. 제3절에서는 디지털자산이 갖는 화폐 기능 측면의 경제적 의미와 혁신금융의 제공 가능성, 그리고 CBDC 도입 논의를 살펴본다. 제4절에서는 현재 논의되고 있는 각국의 규제 동향 및 디지털자사별 규제 방향에 대해 알아보겠다. 제5절은 현재 국회에 제안된 가상자산법안과 디지털자 산법안의 주요 내용과 쟁점을 소개하고 마지막 제6절은 향후 연구 및 정책에 대한 제 언을 하며 논문을 마무리하겠다.
